You are right - but allowing monitoring of communications without judicial oversight creates a presumption of guilt, instead of a presumption of innocence. It also allows abuse by law enforcement with a strong possibility of little or no punishment for such abuse. Our current administration pays lip service to privacy regulations and being on the side of the average person, but then allows the government to walk all over due process in the name of security. No one, and I mean no one, has the right to shit on the Constitution.
