The whole discussion is totally irrelevant. U.S. law is just a local ordinance. Even if we could define it and agree on what to regulate, we'd merely be ensuring that progress in the regulated areas takes place elsewhere in the world.
On the other hand, we already did this with stem cell research. Why not nanotech too?;-(
