All criminal penalties specified in HIPAA state that the offender must knowingly disclose patient info. If the loss is unintentional the offender would probably get a slap on the wrist.
Either way, HIPAA compliance is a pipe dream. Only a very small handful of people have been prosecuted under HIPAA, and I personally see dozens of offenses a day.
