I'm not entirely clear what's going on here, but from the sound of it, you've sold software on credit. If that's so, then you might have what is called a Purchase Money Security Interest, which, although it isn't perfected, could still entitle you to priority over unsecured creditors in the event that the debtor has entered bankruptcy. But you really need to talk to a lawyer.
