    Since Kazaa (for example) is in another country and not just in another state, I don't believe our Government has the jurisdiction. (diversity of citizenship would apply to US residents of another state.)

    Your files are not plain view, either. They actually have to search your account to find them. They cannot use this information they have found without a warrant. Getting a warrant would be a bit harder because they would not be going through with it on US servers. Unless they received a warrant to take your computer and search for illegal files, there is really no evidence they could legally use.

    They were actually trying to pass a law that allowed them to hack into computers using p2p. This wouldn't be masked behind IP spoofing/anonymizers/etc, as they were trying to make it legal for them to do openly.

    Kids with holes in their heads with guns do not occur with any sort of frequency. Gun accidents are very rare, and if you look at the CDC statistics for death, gun accidents are at the bottom of the percentages.

    Sparcity isn't a good arguement against taking provisions. Just because it's rare for a child to die by gun accident doesn't mean a parent should leave a gun out for a kid to find.
