They already do. ALL DivX ceritifed players play DivX 6 video and subtitles and multiple audio tracks. So the same cheap DivX players play these files too.

  6. Ruling Against Acacia Last Tuesday on The Difficulties of Patent Busting · · Score: 5, Informative

The article doesn't include the Markman hearing results that were filed on tuesday. After the filing ACTG lost 40% of its value. Judge Ware ruled against Acacia several times and even invited the defense to file for summary judgement on a significant number of claims. It is not the end, but let's hope this is the first step. Not exactly. Actually Not at all. Microsoft is the only one that can make a WM9 encoder or decoder. This equals Closed. In the mpeg-4 domain, I can play back DivX mpeg-4 with envivio, or Phillips with the cisco decoder and all around the block here. In some cases it might take a small amount of tinkering to the file, but not the video stream. This is because mpeg-4 is an open standard. This is the difference between open and closed. iVast competes with divx competes with whomever else has their own encoders or decoders that operate inside the standards. What makes them open is that they can play each others video streams. Microsoft could be engaging in unfair business practices or whatever, but there really won't be anything that they will be prosecuted on until they tell a manufacturer that they won't license WM9 for their device if DivX is on there as well. That is they evil bit on anti trust that the browser war was about.
