SCO's claim is that IBM introduce SCO's IP into open source. I've not seen claims that the kernel contains SCO IP, but it is the intent of the FUD.
When it is all brought out into the open, IBM probably did copy character-for-character some SCO source, and did introduce it into open source, BUT it is probably a small, seldom used utility that only a few linux distros include.
A concerted effort to provide support for SCO/Caldera to Linux migration for companies would help solve the problem.
SCO's attacks on the Linux community seems to be part of their effort to convert their Caldera Linux users to UNIX. An "open consulting" effort to migrate SCO Unix to Linux might get the point across.
