Its simply a question of timing. Microsoft knows it can't win SCO's lawsuit against IBM/Linux but it serves as a bigger threat than SCO did as a delay-engine. If it can tie things up in litegation, its succeeded.
I find it humorous this happened not long after/before Ellison was quoted as saying Microsoft was on its last leg.
