I think these are two completely different cases:

Those people have already shown interest in your merchandise, otherwise you wouldn't get their email addresses. That is why business cards exist in the first place, so that isn't spam at all.

Of course CompuWidget magazine must allow you do decline this kind of offers, or make it public that your info can be used for this... otherwise how would you get thier subscriber lists in the first place? Like spammers get it?
I think the only way to really separate what is and isn't spam, is in the question 'How did you get target email addresses?'.
