Uh, that sounds like their assertion that the code is already on the disk. 1.6MB is rather large for a simple unlock key, so its more likely a patch which has been compressed. The article states that they asked the question exactly as printed (yet notice they are not quoting their exact question..), but often that's a way to mislead people to stir up controvesy to get people to read the article. If the article was "patch to enable RE5 Vs. is very small," would anyone read it? I don't think so either.

Read the last paragraph; there was no contract entered into by the original seller. That's not quite the same as an EULA, which does require and additional action to use / install software.

"The court did not hold that a contract or license imposed on the first sale could not create an obligation. In this case, there was no contract between the owner and the original purchase."

So no, this question has not yet been answered.

I believe judges can't comment on how they'd interperate beforehand because that would been see as writing the law.. effectively changing what the leglistlate said (or failed to say). Also, while a lower court may interperate the law one way, that doesn't mean a higher court (or even another judge at the same level) won't disagree... so it'd also be a waste of time.

Sorry, none of those give at all the same level of detail as GPS. The GPS can tell where you (or, your car) is every second of the day. The fact that you were at the store at this time only really tells you that; the store doesn't know where you were prior, or after. The same with everything else in your list. Also, the more detailed tracking done in this case is by the government... far more menecing than any of your examples as well.

The government explicity doesn't have the right to monitor us continuously without a warrant. That's what being "secure in your person and possessions" means.

    1. point out to me a society that 100% agrees on anything

Fine, point me to a society which has codified that stealing is ok in some situations.

    2. we're not talking about theft. if i can convince you that you need to buy something, i haven't stolen a thing from you. not my fault you didn't need it. for evidence of this, look up "marketing" in your nearest dictionary.

Well if you want to be technical its fraud. Note that there are fraud cases where the elderly victim did in fact receive what he was promised, technically, but its still considered fraud. See also preditory lending. I'm sure you've heard of these things, and thus there are limits to what you can do to make a buck.

it sure doesn't, but i think we can agree that two humans have an equal right to survive. i have every right to try to sell high-markup items to make more money for myself. if granny is spending her grocery and rent money on computer accessories, you or someone else in your family may want to intervene. it's not the job of the retail salesperson to budget your grandmother's funds.

Nope, ethically what you're describing is wrong. Your intentially misleading someone you know can easily be taken advantage of. I'd like to point out you're still attacking the foundation of society, which is why we have laws against fraud, deceptive advertising, preditory lending, etc. Do you know by law you can back out of a mortgage within a few days? That law came about EXACTLY due to the line of thinking you're advocating. If you haven't figured it out yet, trust is essential for society.

we're not talking about a mugging here, we're talking about commerce; try to keep some perspective.

Ah, so as long as there's no physical violence, anything can and should go.

Seriously, its not hard to earn an honest living, there's not an excuse for unethical behavior. Especially when social programs are available to feed your family for you.

I'm not aware of a large number of Iranians living in Israel.

What you're now arguing is that white people killing other white people, such as WW1 or WW2, is "killing their own people." Tell me, when the French backed the US revolution, were they killing mostly French people by doing so?

You also seem to be confusing jewish people with muslium people. Palestinians are largely located in occupied West Bank and Gaza, and as far as Lebanese people go... Hezbollah is another muslim group, which fired rockets into (largely) jewish israel.

None of that matches your assertion that 40 Iranians are killed in order to kill two or three other nationals. Logically, if that were to happen (you've yet to cite anything like that, either), it would take place within Iran.

Someone that only knows "languages" is a programmer... not a software engineer. You need an understanding of language concepts, which are built on set theory. You also need to know how to design a program. You can slap something together in five minutes that might work... but the slightest change and you'd have to throw it away isn't a great way to design a program usually.

Learn about things like set theory, object oriented programming (which is what C#, Java and others are mostly doing today). Procedural programming is another style... but then there are things like software architecture which aren't limited to any one language.
