OK, I actually work at a small film company. And the owner is very involved in getting the screener ban lifted, as it negatively affects the promotion of his films.
So I can speak from personal experience that in 2004 they are still sending DVDs screeners to Academy members. Period.
Enough speculation and false reports already.

Seems logical to me. Why is it so confusing?

I have an office at one of these companies and yes, they are suing under antitrust laws.
