That's the whole problem and I agree. If we cut off their financial incentive, then they will not continue. How do we go after the money? What we are seeing is that many of the legitimate companies are actually complying the the (I) CAN SPAM Act. The majority of spam and spammers do not obey the rule of law because they are crooks. Most spam are only scams anyway, whether it is email harvesting, phishing, phony or cheap products or the Nigerian crap. Because of this, it is difficult to trace the money. I will say that it is not impossible and I am sure that you will see quite a few law enforcement actions in the next year by local, federal and EU authorities but it is very tedious.
I can tell you what law enforcement agencies need very badly. They need techies from/. to go to work for them. It would probably be a pay cut, but hey guys, don't you want to save the world from scamming spammers?;)

Speaking of spyware, the Federal Trade Commission is offering a workshop on spyware that needs comments. I think it would be highly appreciated if some of you guys would comment.
I completely disagree. If you try internet dating or blind dates it is a good idea. Trust me on this one. I learned the hard way. Anyway, it is always worth a check. You never know what you will find.
I went out on a blind lunch date about 2 months ago. I googled plus did a little extra search. In my state we have most of the public records online now. Anyway, come to find out, he had outstanding warrants for his arrest in domestic abuse, violating a protective order and so on and so forth. I did not turn him in but I sure as heck never went out with him again! Yikes!!
So, where is Carmack? I still think that Scaled Composites has the advantage.

I do not completely agree with you. I do agree that Scaled Composites is the best bet for the X-prize. Anyone taking bets? However, I know people and Kennedy Space Center and at NASA and doing research for Navair. They do not want to ever see any astronaut die and they are far from pathetic. The program needs work but the people should be respected.

You are partially correct but not entirely. The CanSpam bill has preempted most state laws regarding email. It has not preempted the portion of these state laws that specifically deal with deceptive headers and subject lines. However, passing broadly based "mail" state laws will not work. If it is directed at spam in any way, the spammers can come back and fight that it is preempted. They would probably win.
There are a lot of problems with this new law and to be quite frank, I can not stand it. It is still unknown whether or not a state will be able to go after spammers criminally. Under this bill, a state only has the ability to go after spammers civilly. Whoopie!!! I am sure that the spammers are running scared now.
However, many states have criminal laws in place that can be used to go after spammers. *sigh* I am 100 percent positive that the first state to bring criminal charges against a spammer after Jan. 1 will get slapped with Motions to Dismiss based on Preemption. Ugh!
