Such a suit would almost certainly gain a quick, long-term stay pending the outcome of Novell vs SCO battle for the Unix copyrights. (aw geesh your honor, I didn't really know who owned the copyrights, I don't know who to pay, there's a battle going on in court for it right now, etc). And that litigation would probably take years. Meanwhile IBM and Red Hat vs SCO would continue....
