Children NEED privacy, If they can't get it one way they will get it another. If you think you are being a good parent by watching your kid every moment and not giving them privacy round the house you are an idiot, and if you think you need GPS tracking you are paranoid and it will do you no good.
Trusting your kids, and having them trust and respect you is where you want to be and no high tech bling will get you that.
"The bottom line is that NO always means NO, even for a practised sex-worker, but the prosecution must prove that he/she did say NO, in the circumstances where consent was likely, (jury of peers)"
And it is claimed: "Nonsense, consent is an affirmative action, not negative one. That is, the person has to have said "YES" not refrained from saying "NO". As such, it seems consent is an affirmative defense, which shifts the onus of proof somewhat.
You are clearly not a lawyer or you would have known/understood that that amounts to filing an affidavit to that effect, which provides evidence to the effect of that was sworn, but exposes the swarer to a charge of perjury if proven false.
OK, This just repeats the damage political correctness has done to common sense, so in the rape scenario, the victim's past history is clearly relevant to the present allegation, to pretend otherwise is simply daft, it moves the balance point of a rape accusation, which is why the politically correct dont like it.
The bottom line is that NO always means NO, even for a practised sex-worker, but the prosecution must prove that he/she did say NO, in the circumstances where consent was likely, (jury of peers). The woman is always right stuff is nonsense. What is needed is common sense not more guess work.
The whole point of a Jury is that it a Jury of the Accused Peers. And that means that the whole point of having them is to bring a life experience, similar to that of the accused, into the court room,
Thus the jury is the last defence, for the accused, against overbearing prosecutors, clever lawers, biased judges, stupid or corrupt scientists hawking snake oil, or simply the politically-correct 'go-with-the-flow'. This is why they deliberate in secret and the result is not appealable This is a foundation stone of Anglo-Saxon Common Law. Autrofois Aquit stops the state venue or jury shopping.
If a juror wants to Google, Wiki, or Britanica, or read the Bible, Quran or anything else that is their right and this idiot should STFU.
As I have already commented here SUN was fixated in repeating all DEC's strategic mistakes, so while Open Solaris might have been interesting in 1995, it is now just a footnote to OS history, and much of what is said about it is just false. To try to hype it up now is the clasic case of trying to 'polish a turd'. There are two major threads here, and the outlook is complicated by tools, eg GCC, and semi-conductor development.
(1) SUN repeated DEC's mistake of giving the company to Marketing when revenue began its long fall. This never works and has been responsible for the demise of so.o.o much US industry eg GM. Marketing, since it works with Focus Groups, suveys... and picks a biased group of responders, current customers, biggest first, _always_ gets the wrong answers, the company ceases to innovate and be the market leader and better engineered and more economic competitors start to eat their lunch, and further depress profitability eg Linux/86_64.
(2) A consequence of (1) is the best leave. When second rank management & engineers gain control, often driving out the best eg Rob Gingell, the former Solaris Development manager, they begin to behave like politicians and develop 'talking points' which are exactly like emperors cloths. In spite of the fanbois that is exactly what Dprobes, ZFS and Java are. They are a money sewer, and if that were not bad enough, a combination of political correctness and stupidity quickly stifles any real innovation or rational business analysis while the sacred ideas continue unquestioned.
SUN's undoing is entirely its own fault, and no-one should waste any more time on Solaris, open or otherwise. Both Solaris and Java were born and grew up in the Cathederal and their arrogant mid-wives (Dr. James Gosling) do not want their children in the grubby Bazar making money.
Solaris, overmanaged like MySql and OOO can never catch Linux, because of weight of GOOD developers and mindset.
Userland should __NEVER__ be able to crash the OS, M$ fanbois are the reason Windows is as bad as it is! If this was Linux a patch would be issued in hours. See the deref 0 with page 0 mmaped exploit.
Of course it is _VERY_SERIOUS_, un-priviliged user-land electively crashes kernel of every machine it can route TCP packets to, WTF are you stupid or something?
Cursive, normal joined up handwriting that all adults over about 40+ can do was designed to make writing _faster_.
If you were not taught (a) why to do it, (b) how to do it sorry, like most American "improvements" to education it was to take out a readily assessed skill which enabled parents to tell which teachers could teach effectively as most parents, even if they didn't understand Differemtiable Manifolds, String Theory, or DNA codons _could_ tell if their children could write ligibly.
Here, children still learn the Suetterlin form 'http://www.suetterlinschrift.de/Englisch/Sutterlin.htm' and can write legibly in "cursive" from about 10 (5th Grade) and BTW will have had 3 years of English, and be expected to be able to make simple conversation.
Unless they are Swiss, when they will speak Hoch Deutsch, Schweizerdeutsch, Franzosisch & Italianisch, at least at a playground level to incommers from French and Tessin/Italy.
Having read the original blog post this is clearly the vituperative rant of a imagine-wronged academic with which I am all too familiar.
Google is doing the hard work of scanning and attaching some meta-data. Once that is done (a) more meta-data can be added and (b) errors fixed. Additional mete data will be needed as there TWO academic classifications for english, and many more for non-englisg languages.
This is just stupid carping, by those who would rather retain control of their baliwick.
He does not seem to realize that google will be able to search the content making the meta-data somewhat less important.
In the 70's Shirly Williams destroyed the British educational system based on political bias, almost everything she did was wrong and did not work. 30+ years later, most of the Civil Service does not understand statistics or any numerate discipline, these idiots now advise the pols!
This stuff does not have ANY substance and certainly dosn't deserve the description Research. It is ignorant crap.
Why are we surprised that nothing that New, or Old Labor does works?
You, in America, should have learned by now that your your regulatory systems, and courts, do not work well. The SEC and Fed showed this clearly during the 2008 Finance Industry meltdown. The USPO is a running sore. This is because quasi-independent bodies have become hopelessly politicized and pandering to congresscritters.
You need the transparency you trumpet to the rest of the world, or dont expect the EU and GATT to play along. The rest of the world has had enough of corruption in the the USA.
SUN's problem was that they could not figure out What_to_Do, the reason for that was that the founders, Shah, Joy & Bechtalsheim all left and the stars of the second level of management were never sucessfully engaged, and the paren is exactly right, SUN, largely founded by those who jumped ship from DEC faithfully repeated DEC's most significant mistakes,
the Cult of the CEO, Olsen & McNealy
transfer control from Engineering to Marketing
getting into, and spending lots of money on, fights that are Just not Worth Winning, JAVA
SUN grew, and outpaced Apollo (domain) HP and the when HP bought Apollo's market share, both again.
But it did not take long for in-fighting and huberis to set in and bring SUN to where they are today, so that Oracle is today's Compaq.
Oracle will kill both the SPARC and Java track as they exist today as neither can be monetized. It will be very intersting if Java can succeeed on its merits, I hope not, Python is a far nicer language.
Linux is not ready for the Desktop or Enterprise, AC
Nothing can compete against FOSS done right, hopefully this will get OOO really into Open Source, and maybe someone at Oracle, whis is smart, Ellison, will realise they have to do an Exchange.Outlook and OpenSync job properly
All in all this is the very best outcome for FOSS.
An the "security policy" is why the last charge will have to be dropped or will fail and the counter-suite for malicious wrongful dismissal and arrest, and detention should be filed.
I cannot say this kindly, We do not all live/want to live in the USA. Your Ideas and Politics are now so corrupted from the 24/7 cable news and radio talk shows that all you all do is repeat "talking points" to each other.
You have a constitution, separation of powers and apparently a democracy, but in reality you have a hopelessly corrupt Congress, an inefficient and ineffective Executive and a Supreme Court which sits, unable to effect reform, of the most broken legal system in the world. You are a public laughing stock.
Now since I am not a citezen of the USA, far be it from me to tell you how to fix your system, but your worries of demagoguery sit far better on Bush+Cheney than Obama, the former running a horse and cart through your own Constitution daily, before plunging you into the bigest financial disaster for a centuary. An still you cannot unite, over any meaningful issue to help save your country. Bad and false, in the German meaning, regulation got you into the financial mess.
You need working education and effective health care more than most, but your congresscritters continue to lie about the state of US healthcare, and don't talk to me about education. Your health care system is good third world, at best, and it costs you an arm and a leg; I live in Switzerland, one of the highest cost countries in the first word but my "krankenkasse versicherung" is half what I would pay in the USA, drugs likewise and We do not have constant NEOSARCOMEL infections eg MRSA, e-difficile in our hospitals... because the cleaners clean!
"And Google just loves people like you", how dare you be so god dammed insolent, if you can not keep be civil be quiet.
Google has, once again, tried to contribute to the available knowledgebase for mankind, and will spend a lot of money scanning, OCR-ing and Indexing the worlds libraries, for the vast public good, maybe re-creating a modern Library of Alexandria, which, with modern technology cannot ever be destroyed again.
You and other American short sighted creeps, who cannot see benefit to human progress from the freedom and codification of all human knowledge should crawl back into the darkened holes in the earth wherein you studied for your MBAs and LLDs and with your CPAs from the big 4 accounting firms have done more to damage to the Economy and Trust than you can imagine.
Put your own house, Law, Patent, Copyright and Intellectual Property law in order first, and do not EVER AGAIN, dare to lecture those of us who live in honest, law abiding countries.
We are terminally fed up with your arrogance, stupidity and failed methodologies.
You have the Sherman and Lanham acts to deal with monopoly, when I see them being used aginst AT&T, M$, the RIAA & MPAA cartels and the idiots that brought us ISO OOXML by publically corrupting ISO I might listen, but in reality you are OVER, you have destroyed your educational system and business, enjoy becomming the newest third world country!
Well I have read the book and the much funnier "Secrets and Lies" AC about 3 times and Secrets and Lies more. First AC is in the nature of a scholarly review book and introduction to mathematical and procedural cryptography. It says nothing DEFINATIVE about particular ciphers but DOES make the point that all cryptography depend on mathematically difficult problems that Mathematicians have an annoying problem of simplyfing, and this is the nature of the MD5 and SHA1 attacks, and the advice to "walk not run to the exits". Rijndael aka AES is much better than 3 x DES and the new hash will be better than the SHA family.
This stuff is not snake oil, but you need to understand it at a mathematical and process level to get good results and you need to test, see the Debian SSL fiasco.
So, for example SHA1 is more than fine for all practical purposes in the version control system 'git' where only accidental collisions are concerning. For all the security bruhaha about SHA1 no one can tell you how to forge the message that you would like to send with a given known SHA1. Most people will notice if they see a message "send a cammel ein milliarde swietzerish franken to the First Crooked Bank of Nigeria" (deliberate errors). So unless you can fix the SHA1 with spaces and <CR> <LF>, in small numbers, and you can not you are SOL.
And any valid process encrypts both the message plain-text AND the hash, and to be useful the HASH better depend on the senders private key and be de-cryptable by their published keys (fingerprint freely available) eg
sig. omb GPG Key ID: 0xy0481D676FBC700y, old PGP Key Id: 0xy97186Ay
Finally, the idiot pols in the USA and UK could do just one thing useful, issue everyone a high grade X509 cert for free and sign the Social Security or NHS number using the private key.
This looks, at first case badly flawed, since all private keys are known and held by government whereby they can be mis-used or lost.
I leave it as a simple, excercise to the reader to turn this into a very cheap, foolproof security system which absolutely stops identity theft.
I, for one, am getting really fed up with people trying to get in the way of Google, and others making more information available, for free. And on the thinest pretexts. There is a huge difference between protecting the public right to privacy, as has recently ocured here in Switzerland and this endless carping by libraries and copyright holders about orphaned books etc. In the UK a condition of copyright in a requirement to offer a small number of copies to the so called Copyright libraries eg the British Museum.
If we are serious about scholarship in the internet age we must do something similar, allow google and others to scan and index books provide short extracts free for fair use while selling complete electronic copies through retailers. The same for learned journals.
Every time I hear nonsense from libraries, journal providers and content providers (think Murdoch) I smell hipocracy and corruption thick in the air.
The US is __not__ overegulated, it is just poorly regulated, and has far too much politically and socially motivated regulation eg Bush, stem cell lines, [security] Id cards.
Much regulation is either WRONG, or INADAQUATELY ENFORCED, particularly in the finance sector, eg:
(a) Naked Shorts (b) Incorrect MARK TO MARKET (c) Capital Adaquacy (d) Insure un-owned asset (e) Late transaction settlement
you need the above list fixed before the next implosion or down turn.
Of course this is right, and we need to re-encourage investment in basic science in all of the goverment, Universities and Industry and it needs to be in Basic Science, _not_ short time applied science, engineering or product development and anyone with an MBA needs to be disqualified from any part of the decision making as do almost all pols, except to do it.
The problems are: (a) short term-ism on Wall Street, (b) good and improving engineering education in China and South East Asia (c) the fallacy that the "great and good" running research councils can usefully direct research, a few can, but most are politicized old farts!
Remember, must of the most vital discoveries were accidental, eg the Transistor at Bell labs and that the only way to ensure that we get that fall out is to undertake serious sustained investment in Mathematics, Physics and Chemistry.
Engineering, while important is nothing like such a fundamental innovator, sure let us also invest in Computer Science & Engineering and the Life Sciences, where much profit can be cheaply mined, but it is in the basics where the big new technologies start.
A simple example, all the green-renewable-energy sources, and the mistakes deploying them could be bypassed by a small safe fusion reactor in the 200-10,000 KW range, which would remove dependance on foreign oil and make energy esentialy free. My BM 735i needs about 270KW so it could power cars, planes homes... without a new lot of un-intended consequences. Ethanol and the price of basic foods anyone.
The whole problem with NASA is it became hopelessly politicized. Thus, as has been proved with the Bush administration, planning was done in the interest of the 'good old boys', rather than scientific and engineering reality.
That is why the shuttle was not re-furbished and failing components, like the booster tank foam re-designed so it didnt fall off.
The shuttle should be re-ferbed, and more built if needed, see the F15 aircraft programs. Commercial competition should be embraced not excluded and rational program risk analyses re-instated but most of all NASA needs to be run by senior engineers not political flaks.
Children NEED privacy, If they can't get it one way they will get it another. If you think you are being a good parent by watching your kid every moment and not giving them privacy round the house you are an idiot, and if you think you need GPS tracking you are paranoid and it will do you no good.

Honestly English spelling is the most inconsistent mess on Earth, and is in urgent need of reform.

The shuttle should be re-ferbed, and more built if needed, see the F15 aircraft programs. Commercial competition should be embraced not excluded and rational program risk analyses re-instated but most of all NASA needs to be run by senior engineers not political flaks.
