As a scientist, we never say something is "only a theory, not a fact". Colloquially, a theory means a guess, but in the world of science, a theory is backed by mountains of evidence.
Einstein didn't just wake up one day and decide that Special Relativity must be true, call it a theory, and be done with it. Years and work and experimentation went into it before it ever became a theory.
