Agreed. It is very likely that a court could say the First Amendment doesn't apply in a civil case, since it isn't government censorship,

I have seen this view stated a number of times, and while I am neither a lawyer nor an American surely this is not what your first amendment states. It does not say "Congress (or the government or federal agency) shall not censor or directly inhibit free speech." What is say is "Congress shall make no law...". Laws are what governs the behaviour of the people not just the government. Civil cases are just as much a matter of law as criminal cases, and these laws must be just as subject to the first amendment as criminal law.

  9. Why do we need certificate providers? on Verisign Buyout of Thawte Consulting Challenged · · Score: 1

What real purpose do Verisign & Thawte serve?
For correspondents with whom you have previously had contact, simply digitally signing a document gives high confidence that it comes from the same source as previous documents signed by the same key. Thus a 3rd party certificate serves no useful purpose for already established relationships.
For first-time contacts, how much do 3rd party certificates really tell you about the certificate holder? Is a simple digital signature (without a cert) not just as reliable as letter with an unknown handwritted signature? (Or even more reliable as the digital signature also ensures that the document contents have not been changed since being signed)

  12. Spam worse than paper junkmail on Secret Spam Summit Held in Washington DC · · Score: 2

As well the much mentioned "Spam costs the recipient, junk snail mail costs the sender", the main difference I see between postal junkmail and Spam is the relevance of the material. Apart from "opt in" mailings (to which I have no objection, otherwise I would not have opted in) from companies with whom I have had contact, all of the mass emailings I receive fall into one of 3 types - either selling email addresses (or Spam softare), adverts for porn sites or "get rich quick" scams. None of which I want to receive. The DMA say about small companies needing to send out details, but I certainly have never received that type of Spam - and as long as it was reasonably targetted (eg not restricted to US residents but sent worldwide, and for a product or service that I might be interested in) would not be so bad as the current Spam.
