the law is there to punish people after they do it, not to stop them. so who needs controls for that? just punish whoever you feel like, whenever you feel like! just like speeding laws...
the chinese way however is very different. they want to control the information coming into the country because the information itself is dangerous to them.
go to China. every single person has at least one cell phone, sometimes two or three. most of them constantly use the entire functionality of those phones. america is a little behind the game on cell phones. we still mostly use them for audio (talking, voice mail).
no need to restate, as the other posters have clearly said that wether you want it or not lots of people do, and it exists, and it's only going to get more complicated, as is the nature of things, so there is no purpose in discussing any other possible situation, other than what is really happening.

well.. even if they can trace back to the computer, that doesn't mean they can trace back to the human. that's rule number #37 of the hacker's handbook of covering your ass. make sure that the you're covered beyond just the computer. hacking from a system that's in your bedroom is stupid when you can easily go to an internet cafe, library, university computer lab, etc.. also if you're gonna do it from home (because the publicly available ones are too obvious or restricted) then you'd better damned well just buy a junk system that you can dispose of as needed.
if you're doing something where your life, or personal freedom are on the line, it's worth the money.
