Personally, I think it is a good idea to try and protect children from undesirable spam that promote things like alcohol, tobacco and pornography. Society often takes on the responsibility of protecting children when supervision is not available from parents. This is why we have crossing guards when children walk to school, security guards on high school campuses and programs like Head Start and Foster Care. The guiding principle of such programs is that you don't penalize the child when a parent isn't fulfilling an important or critical need.
The real issue here seems to be that these programs are designed by lawmakers who don't necessarily understand the technology they are legislating and, therefore, have a difficult time striking a balance between protecting children and infriging upon the rights of adults.
