A man who downloaded dozens of child porn pictures won't be sent to prison - partly because of overcrowding in England and Wales.
Derek Williams was given a suspended sentence.
Judges have been told to only put the most dangerous criminals behind bars for the time being.
A Downing Street spokesman said advice was sent to judges on sentencing but only as a reminder of the guidelines.
