But if OS programmers could see the code, then more patches would be upstreamed back to M$ right? And that should help them fix the leaks in the other versions of windows that relied on Win98's codebase?

Maybe M$ should just release the source for this now. Even if its in a license that they made, aslong as the community could contribute and look at the source code and it could be distributed without charge.
It would be a shame to throw away the compatibility that win98 had.
