The OpenBSD "team" clearly ripped-off the HAL for the Atheros driver (its trivial to see this once you can see the Atheros HAL source.) I don't know what they did or didn't do on other drivers, but their behavior on the Atheros driver can't be called "reverse-engineering" (clean room or not).
Using the OpenHAL is a good way to watch your favorite linux (or openbsd) distro get whacked with a lawsuit.
Feh. "Open Source" is a marketing term promulgated by Eric Raymond in order to distract people from Free Software.
As ESR put it, it was a "cold blooded exercise in re-branding" in order to change the message from Software Freedom to a business model.
That is all.
As such, Open Source will always be an excuse-to-be-unfair.
