Google Offers Scanned Books To Rival Stores
eldavojohn writes "Yesterday we covered Microsoft's jabs at the Google book deal, but today Reuters is reporting that the scanned books will be available to Google's rivals. Google said in a surprising statement, 'Google will host the digital (out-of-print) books online, and retailers such as Amazon, Barnes & Noble or your local bookstore will be able to sell access to users on any Internet-connected device they choose.' They made this statement today at the US House of Representatives Judiciary Committee that had been called to discuss criticism of a 2008 settlement between the Authors Guild and Google. Well, I would bet this has caught more than a few people by surprise. The Authors Guild offers a history and the fine print of the agreement." -
Opting Out of the Google Books Settlement, Pro & Con
Here are diametrically opposing view on what authors should do about the upcoming deadline to opt out of the Google Books settlement. Miracle Jones writes "The William Morris Agency has come out strongly against the Google Books settlement for its clients, citing the fact that the settlement creates a non-competitive marketplace for a whole new product (orphan books), in addition to containing provisions that will make it impossible for writers to remove books from the database after 27 months have passed: 'We believe that the license being given to Google to publish and display with impunity out-of-print "orphan" works (where the rights owner is unknown and estimated by the Financial Times to be between 2.8 and 5 million books out of 32 million books protected by copyright in the United States) will open the door to establishing Google as the most comprehensive database, potentially a monopoly, with unfair bargaining power.'" On the other side of the debate, James Gleick writes "With the deadline approaching for 'opting out' of the Google Books settlement, the Authors Guild has posted an aggressive explanation of who it thinks should do that: no one. Not a single author in the world, it argues, stands to benefit from removing himself or herself from the class. This comes as part of a new set of 'Answers' meant to push back against what the authors group thinks is widespread confusion about the settlement; they also address questions about just what kind of money we might be talking about, and what kind of control authors will have over Google's use of their work." -
$125 Million Settlement In Authors Guild v. Google
James Gleick writes "Authors, publishers, and Google are announcing a huge settlement deal today in their lawsuits over the scanning of millions of copyrighted books in library collections. Google has agreed to a huge payout for books that were scanned without permission, but now they'll be allowed to scan the books legitimately. Most important, they'll be able to put millions of books online, including those still in copyright — not just for searching and not just in snippets. There is a groundbreaking new licensing system meant to make the books as widely available as possible while protecting the authors' copyrights and enabling them to share in the revenue. Some will differ, but personally I think this is a wonderful outcome, for readers and for authors alike." -
Authors Guild Sues Google Over Print Program
heavy snowfall writes to tell us that The Authors Guild has filed a class action lawsuit against Google. The lawsuit claims that Google's scanning and digitizing of library books as a part of the Google Print Project constitutes "massive copyright infringement". In addition to the lawsuit The Authors Guild has also issued a press release to explain its actions. -
Amazon's Book Search Hits a Snag
The Importance of writes "Yesterday, Slashdot readers discussed Amazon's brand new, technically impressive and highly useful book search feature that lets users search the full text of over 120,000 books. Today, the Authors Guild is saying that the publishers don't have the right to let Amazon do this. Uh oh." -
Amazon & Used Books II: Bezos Strikes Back
theodp writes: "Last week's call for authors to de-link Amazon from their sites has reportedly prompted Jeff Bezos to fire off a letter to all Amazon Marketplace sellers, asking them to help out by sending e-mail on Amazon's behalf in response to the Guild's call for Amazon to stop placing prominent used book ads on each title's main web entry and soliciting new books purchasers to resell their books through Amazon shortly after purchase. Bezos wants everyone to be 'super-clear' that Amazon.com is supportive of and good for authors, indicating that Amazon's steep discounting of new titles and royalty-less sales of used books are two examples of how Amazon helps the book industry and authors. Good to see Jeff's found a new cause, since it looks like he's done with up patent reform." -
Authors Guild To Members: De-link Amazon.com
theodp writes: "Angered by Amazon.com's practice of offering [prominently placed] used editions of relatively new titles, the Authors Guild is urging authors to replace Amazon.com links on their web sites with links to Barnesandnoble.com and BookSense.com. Amazon spokesperson Patty Smith insisted the policy really "ends up helping authors and publishers" although neither the author nor the publisher receives royalties from Amazon's used book sales, and Smith could not cite an author or genre helped by the availability of used editions. " CD: I'd imagine they don't want us to go to our local used book stores either? This is the second time they've tried to call Amazon to task for this. -
Publishers/Authors Angry at Amazon Selling Used Books

In my opinion there are plenty of subjects for which Bezos deserves to be berated, including overly agressive accounting tactics, and their one-click patent. But selling used books?
The Authors Guild's argument is that authors don't get any compensation if someone purchases a used book; only the seller and Amazon.com make out on the transaction. So when amazon.com makes it easier for consumers to buy and sell used books which could also be purchased new --- at a more expensive price, of course --- it hurts the authors. The Authors Guild and the Association of American Publishers would prefer that Amazon.com only allow their users to sell used books if they are out-of-print books.
Well, excuuuuuuuse me! I can understand that authors need to eat, and send their kids off to college, and all those good things. But if a book wasn't good enough for me to want to keep it, why shouldn't I be able to sell it? Using the same logic, the Authors Guild should logically be against public libraries. After all, people who use libraries can (oh horrors!) read a new book without having to pay for it!
This really goes to show the fundamental tension between content providers and consumers. If you take the Authors Guild position to its extreme, you'd think that they would much prefer that bookreaders purchase books from bookstores, and if they didn't like it, that they throw it into a landfill rather than resell it or give it away, or lend it to a friend. After all, all of these activities compete with new book sales. Fortunately for us, the doctrine that the owner of a book is allowed to do all of these things is fairly strongly encoded into law --- which is why all the President of the Authors Guild can do to write a whiny letter to Bezos asking him to please don't do this.
And thus we see the danger of the positions espoused by the Software Publisher's Association, and UCITA. Not only do they wish to take away our rights about what we can and can't do with software --- including rights which common sense would dictate are perfectly permissible in the case of the physical world, such as selling or loaning a book to a friend --- but their actions have emboldened folks such as the Authors Guild and the Association of American Publishers to try to take away rights which we always have had in the physical world. After all, if the software vendors can restrict what you can do their software, why shouldn't a book publisher be able to restrict what you can do with their books?
Fortunately, most book publishers don't have as much money to throw around as Disney, so they probably won't be able to purchase enough Senators to change copyright law to suit their purposes. But when thought patterns of the SPA have started infecting traditional book authors --- who really should know better --- it's obvious that we're living in dangerous times."
