Re:Not so funny when/if the seller commits suicide
"There was another Diebolded election just 2 years ago..."
Depending on how selective your memory is, you might remember that ALGORE CONCEDED DEFEAT IN 2000 BEFORE CHANGING HIS MIND.
The fact of the matter is that the margin of victory in the Florida presidential election was smaller than the margin of error. Algore's advisors convinced him that all he had to do was manufacture a few hundred votes in a recount of hanging chads and he could manufacture a win.
HOW GEORGE BUSH STOLE ELECTION 2000
"Al, this is David Boies of Boies, Schiller & Flexner LLP, America's richest trial lawyers. I apologize for calling so late, but this won't wait."
"Look, I know you've already conceded, but I've been talking to some folks in Florida and they think they can find enough extra votes down there to give you the state in a recount."
"Just a recount in Volusia, Palm Beach, Broward, and Miami-Dade counties, though."
"If it goes statewide our people will be spread too thin to keep things under control."
"Do you want to give it a try? At this point you've got nothing to lose."
"That's great, Al. I'll give 'em a call and we'll get this show on the road."
"Call Bush right away to let him know you've changed your mind."
"On second thought, call a press conference first."
"Talk to you later, Mr. President." -
Re:Lies, damned lies and statisticsI don't recall ANY stories about widespread election machine problems when Clinton won, or Bush 41, or The Great Communicator, or Jimmy, or Nixon... but gosh, here come the electronic closed systems, and all of a sudden there are large reports of irregularities?
Calling people douchebags is a sign of intelligence.

Re:Lies, damned lies and statisticsDoesn't the fact that everybody is so concerned that Kerry lost show that maybe the wrong person won. Or there is enough doubt that the election was fairly won that serious investigaitons are not without merrit.
No, all it shows is that the losers are sore losers.
Again

It's Boies Schiller
Just a minor correction. Their website, actually very well done for a law firm, can be found at www.boies-schiller.com.
As a side note, I'm a law student and Boies Schiller is an interesting firm. They are one of the three highest paying firms in the country, with a first year starting salary of 140,000 per year as opposed to 125,000 for the majority of large law firms. They are headquartered in Armonk, NY as opposed to New York, NY.
David Boies is the premier partner. He left another high powered firm, Cravath, to start his own firm (Cravath is strangely enough representing IBM in this case). Since then, some say that Boies Schiller has become the cult of David Boies (hyperbole). I think that both his sister and brother have high management positions in the firm.
Regardless, from what I hear, Boies is one of the best litigators in the country. Cravath has good litigators too. This case will be well argued - and that is a good thing. -
Re:We can only hope
I've heard unsubstantiated rumors that David Boies has backed away from the case personally, but the case is, of course, still being handled by Boies, Schiller & Flexner. As circumstantial evidence, notice that most recent legal statements from the SCO camp have come from Mark Heise, a less important partner in the same firm.
I would not argue with people calling Boies overrated, myself. -
Re:sco.txt fake ?
Speaking of lawyers, now that the SCO execs dumped stock already, the lawyers are the only ones left making money on this miserable situation. For example, SCO's main law firm and especially their Partner-In-Bed (is that an official term?) w/ SCO, Mark Heise in the Miami office.

What a moron!Question: What if, during the course of discovery or another time, you find that the code was originally under the GPL?
Answer from attorney: "...well, let's use an example. Let's say you have a hundred files, and you put one of your hundred files under the GPL. That doesn't mean you've lost the rights to your other 99 files. So I don't think it's going to have an impact."So, I guess that means that if lines of 'their' code is used in, say, 20 files used in Linux - where Linux has thousands of files, that this gives SCO the right to ALL OF LINUX?!!
The babbling of this lawyer is comical. You can tell he's trying to defend an issue on some pretty thin claims.
Here is his "Lawyer Profile" from the Boies, Schiller & Flexner LLP:
Mark J. Heise is a partner in the Miami, Florida office. His main practice areas are complex commercial litigation and class actions.Since joining Boies, Schiller & Flexner LLP, Mr. Heise has represented The SCO Group in its significant intellectual property claims involving the licensing of the UNIX source code. A case that has become increasingly dificult to pursue ever since he broke the lead on his pencil. Mr. Heise is also involved in numerous class actions, including as lead counsel in a case against the City of Miami on behalf of persons who paid an unconstitutional parking tax.
A lawyer that is fighting the world on the use of 'unlicenced Linux' products while simultaneously fighting parking tickets. Sounds like a winner to me!

Re:Please!
Meanwhile SCOX will plumment and leave a lot of angry investors.
But you know who walks away rich? Not just the SCO execs who dumped stock already, but the lawyers. For example, SCO's main law firm and especially their Partner-In-Bed (is that an official term?) w/ SCO, Mark Heise, partner in the Miami office. -
the law firm
That boies title in the partner's name caught my attention.
I checked out the site:
"...in 1998-2000 Mr. Boies served as Special Trial Counsel for the United States Department of Justice in its antitrust suit against Microsoft. Mr. Boies also served as the lead counsel for former Vice-President Al Gore in connection with litigation relating to the election 2000 Florida vote count."
now where exactly does this fit in the irony spectrum?
