Re:How would that work
One news source (here) has him continuing to tweet that the event was still on after the police and/or mall tried to shut it down. If that is the case (I can't speak for the reliability of that source, though it does seem a more plausible scenario), then the police were not acting improperly when they arrested him. They might have offered him the opportunity to tweet a cancellation to avoid arrest in that scenario.
The problem is that everyone seems to have seized on the "arrested for not tweeting" story, so no one appears to have actually checked the Twitter feeds and the timeline of what happened. It would be nice to have some actual facts about what happened, rather that "OMG! Arrested for not tweeting!"

Re:What? (Think Again)
You would think it wasn't affected, but the truth of the matter is Talk Radio is also required to pay a per listener fee to Soundexchange for broadcasting over the Internet. It's slightly lower, but still required. The thought process is they might play music that is commercial. Given RIAA logic, that means they must pay all the time.
That is why NPR fought so hard to prevent the higher Royalty Rates. They knew it would kill the growing Internet side of their broadcast.

http://arstechnica.com/news.ars/post/20070320-npr-fights-back-seeks-rehearing-on-internet-radio-royalty-increases.htmlI ran two Internet Radio stations myself. I have already shut one down and I am debating shutting the second one down. The whole situation makes me sick at my stomach. I use to love music, but not any more.

Waiver only covered publicity, not medical issues
...according to this article. Indeed, a nurse called during the contest to warn that what they were doing was dangerous and was dismissed by the DJs.

Re:Killed??
But did she know that? Did the station inform her? Did the station know? When she started to feel sick, is it reasonable to expect her to go to the emergency room just for drinking water? And even if she had, was it already too late at that point?
According to this related article, a nurse called in to the radio station and told them that drinking water like that could be dangerous, and was rebuffed by the DJs. Regardless of whether that was true, it's pretty clear that someone is going to get the shit sued out of them. -
Re:Howard Stern? Is it still 1995?
Howard Stern? Is it still 1995? Honestly, I can't think of anyone saying anything about that guy since he jumped to some subscriber radio service and nearly killed it.
I think you're thinking of Opie and Anthony.
FYI, Opie and Anthony broadcast on both XM and CBS' FreeFM in the mornings, and then switch over to an XM-exclusive portion of the show after a few hours. Of course the irony of Stern being replaced on FreeFM by the duo he gagged a couple years earlier is not lost on humble fence-sitters like myself. Regardless of who has the larger audience, I'm sure Howard is laughing all the way to the bank. -
I'm still waiting...
for the sound of that resounding *SMACK* as the gates of Sony/BMG hit the collective arses of the executive brain trust responsible for green lighting this reprehensible action in the first place.
Unfortunately the usual suspects are busy defending them. -
Re:Gonzales says its about "terrorism"

Gonzales says its about "terrorism"The best quote is here and in a few other articles
...Gonzales said the new laws are needed because evolving technology is "encouraging large-scale criminal enterprises to get involved in intellectual-property theft." He added that proceeds from copyright piracy is used, "quite frankly, to fund terrorism activities." [Emphasis added]
There you have it folks. The US Attorney General says that this technology is funding terrorism, presumably with zero-dollar bills. I don't know about you, but I'd say 99% of the intellectual property "theft" (his words, not mine) are going on TOTALLY FOR FREE.
In fact, if they did succeed in shutting down these new technologies for the common man, you can bet that would be the only time the criminals started making massive money on this. Gonzales's plans will actually encourage criminal profits and, therefore by his logic, encourage terrorism. Gonzales is actually taking steps to put the money into this for terrorism and crime lords, not the other way around!
So if you ever wanted damning evidence that our AG both doesn't understand the issues, and is in the back pocket of the content corporations (RIAA, etc.), and that he wants to play the "terrorism" card (like they did about Drugs)... there you go.

Re:But who makes that distinction?Well, if by, "a fine back in '92" you're suggesting that he's had an unblemished record otherwise, no, apparently not. In fact, it looks like he's had brushes with the FCC since 1988.
As for the firing, I was actually referring to his departure from WNBC in New York (paragraph 7, I think), a few years after the Air Florida incident (for which, I might add, I would have fired him myself.)
Do I care if he says "shitpissfuckniggerspicasshole" on the air? Not a lot. Like I say, I've been ignoring him for over 20 years, and since he ignores me as well, we get along fine.

YES IT IS ClearChannel!!!!
Clearchannel owns 1,200 stations, if you think they don't control the NAB, and a large portion of the broadcast media in the United States, then you are living fantasies.
They also own almost all (literally) of the concert venues, and even the ticket agencies. They use tactics that would make Bill Gates proud, and they are in bed with theGeorge W. Bush administration.
When I have more than 5 minutes to spend digging up links, maybe I'll post a proper synopsis of what this evil empire is really about, although it'll be wasted at slashdot, and its probably been done better by somebody else anyway.
Lets vote this maniac out of office. If we don't then you can expect to see events unfold in a similar fashion to what transpired in Europe a little over 60 years ago, with the key difference being that weapons new exist which could destroy all life on this planet.
GWBush is a madman, and he has to go!!!
