Is their license agreement for real?
How can they justify the copyright on a specification extending to every implementation? I can write a program that reads/writes RecipeML files without including any portions of the spec or DTD. Actually using the "RecipeML" mark might be another matter, but that has nothing to do with copyright.
And what's with "THIS SOFTWARE" in the disclaimer? What software? The license is only applied to a spec in english and in DTD form. As far as I can see, "FORMATDATA" has not provided any software of their own at all.
I dunno, it just looks like a poorly adopted BSD license done by someone with a deficient understanding of the applicable laws. IANAL, but from the looks of things, neither was anyone involved in the creation of that license. -

Mention that your site/software uses RecipeML by name.
Not that it's all that restrictive, but sheesh, it's a markup language. The value comes from having as many people use it as possible. The license makes me suspect they're trying to make a buck somehow, which I view as putting the brakes on making it ubiquitous.
(If it is software, you need to get permission first.)

Re:Why oh why XML?
XML has provided a set of rules for developing file formats. If you have ever had to sit down and think about how to make your information available to other people to use in their applications it's great. If you are dealing with semi-structured data like recipes it is ideal.
Yes it is verbose and overkill for highly structured data but until someone develops/markets a method of developing file formats that are not verbose more suited to machine transfer its the best I am aware of.
I do think we need this extensible binary formatting language or what-ever it would be, but until then XML is allowing groups of people to agree on standard file/data formats a lot quicker and easier than starting from a blank piece of paper.

Suggestions: RecipeML, Docbook
I'd rather see the "book" released as a collection of RecipeML files, so that I could re-arrange/import/manipulate them down the road...
I care nothing about Word nor PDF. Give me docbook sources, so that I can [again] reformat to my eBook for use in the kitchen... or to my custom kitchen appliance, should I ever make that exist.
Given the state of the populous [sedentary, generally-low-metabolism males] I'd try to focus on healthier stuff. For instance, Chicken in Mango Sauce is quite tasty [just made it last night], and is better for you than corndogs.
But, I don't see why this is better than SOAR^H^H^H^Hrecipesource.
