To get the facts straight, watch the documentary
The documentary about Kevin Mitnick, made by 2600: Freedom Downtime: http://freedomdowntime.com/ Really good documentary, if you see the DVD version, it has many hours of interviews with Kevin Mitnick. This documentary won the New York Film Festival, best documentary award.

Watch the movie..
For anyone interested in what is probably the most factual telling of the conflict between Markoff and Mitnick, check out Freedom Downtime.
I saw the premier in New York, and have no doubt that Markoff is just out to make another buck. Markoff attempted to get a movie called 'Takedown' produced and released while Kevin Mitnick was being held without a trial. In the movie, Mitnick is found guilty, and they wanted to release it before his case ever went to trial, which would have severely reduced his chances of getting a fair trial.

Check out "Freedom Downtime" the 2600 documentary!
Everybody should go buy Freedom Downtime. It's a two hour long documentary on the Free Kevin movement. There's also a lot of info on the injustice down to Bernie S. This is a great and entertaining way to learn the facts about how the (in)justice system screwed Kevin Mitnick.

It's amazing how much sympathy has poured out for a guy who stole people's credit card numbers...
I believe you're referring to these credit card numbers. Note that all three of those links indicates that Mitnick was not alone in obtaining those numbers.
If you watch Freedom Downtime (buy it there or search the web..you're encouraged to share this one) you'll see the creator of DefCon (I believe that's the con..) saying how that file was traded like "bubble gum" and that "everybody had that file ... If you didn't have that file, you were nobody."
Mostly, the sympathy is for being accused of things he did not do. -

I wouldn't worry (though, it would be sad if constraints are placed on the DVD), I'm sure that a truly open DVD is on the way.
Unless, of course, Goldstein uses the release of their DVD as a chance to give a big FUCK YOU! to the DVDCCA/MPAA and makes it CSS-encrypted and in region 5 (or whatever). However, given his stance on sharing ("We want to get the information out there. Don't ask if you can share, DO IT!" Paraphrasing, of course.) I don't see why he would want to do that to his viewers. -

Mitnick's pals at 2600 produced Freedom Downtime. It's playing at film festivals now...
I used to listen to Emmanual Goldstein's radio show Off the Hook on WBAI in NYC when I lived there. Anyone with a RealAudio player can catch it Tuesday nights at 8pm EST5EDT (Wed morning @ 00:00 UTC). People should give it a listen. These guys are not the deamons the media makes them into. Eric/Emmanual's courage to speak the truth: that being curious about technology is not a crime, and generally speaking out against tyrrany has been a personal inspiration to me in my life... -

Not exactly what your looking for, but the movie Freedom Downtime might be worth a look. It was created by the 2600 Magazine people, the same folks that were sued for hosting and linking to the DeCSS code as part of a news story they ran on their website.
It doesn't deal with the DeCSS case specifically, but covers the good old topics such as mighty state and corporate entities that repress of information, and harshly penalizes harmless people who figure stuff out.
