This right here might be the grounds to sue him, did he dissolve the company before the company was held liable for the costs of the recall? If the company runs out of funds that's OK, but if you funnel money out that is not.
Funneling money out after taking on liability would be called fraudulent transfer. I suspect they weren't that dumb. Based on buckyballs' website, their assets were transferred to a liquidating trust, for the purpose of dispensing with the company; therefore they can file their claims against the trust, so no... that's not a good reason to sue the former shareholders: On December 27, 2012 Maxfield & Oberton Holdings, LLC (the "Company") stopped doing business and filed a Certificate of Cancellation with the Secretary of State of Delaware, thereby ceasing to exist pursuant to applicable Delaware law. Re:Limited liability
The purpose of the limited-liability corporation is that corporate liabilities stop with the company's assets and do not follow into the pockets of the owners.
It could be that the court has decided to allow piercing the corporate veil. The exact criteria depends on which state, that the corporation is incorporated in, but there are various conditions under which Limited liability no longer applies or gets overridden due to the circumstances (such as violations of federal law; or refusal of officers to comply with a court order).
Based on getbuckyballs.com/; it seems that Maxfield & Oberton Holdings, LLC is an LLC formed in the state of Deleware; therefore, it will be a matter of Deleware law.

And perhaps be required to restore the business of the small company (Maxfield & Oberton) which they knowingly and maliciously targeted and DROVE OUT OF BUSINESS just to get more publicity around how wonderfully they are "protecting" us all by preventing adults from buying such dangerous, lethal products, that were never marketed as kids toys, and even after the company previously agreed to and implemented, large prominent, and decidedly overkill warnings in multiple locations on every package sold.
The CPSC have their heads so far up their posteriors they can only talk out one of their remaining orifices. Why not go pick on something that's actually dangerous, like skateboards, or plastic forks, which cause several orders of magnitude more deaths and serious injuries. Seriously, just as many people have died from airport flight information boards falling on them as by stupidly ingesting buckyballs (or being allowed to do so by incompetent caregivers).

These retailers have agreed to participate because Maxfield & Oberton has refused to participate in the recall of all Buckyballs and Buckycubes.
Nice to see that Maxfield & Oberton were willing to brave it out and stick up for themselves and our rights to own Buckyballs! Let's go see if they have any reaction to the news on their homepage.

Same exact packaging you show. Except in these pictures you can see the left side of the packaging more easily. The warning is pretty obvious to me.

But magnetic Buckyballs are not inherently unsafe. They are inherently unsafe for small children. Same as darts, marbles, balloons, plastic bags inside products, gumballs, and hundreds of other things that have no real utility. Targeting this one product while not banning all of those other products I listed above is a clear example of a double standard.
The CPSC is wrong. There's no grey area here. The product is plainly labeled. I present to you Exhibit A. As you can plainly see, almost half of one side of the box is a giant warning label telling people:
Keep Away From All Children!!
Do not put in nose or mouth.
Swallowed magnets can stick to
intestines causing serious injury or death.
Seek immediate medical attention if
magnets are swallowed or inhaled.I'm sorry, but you really can't get much more clear than that. If the parents truly did not know about this risk, then they were grossly negligent in their use of the product. Period. Countless legal cases have upheld the principle that a manufacturer cannot be held responsible for harm caused when a product is used in a grossly negligent way. I can't believe you're seriously arguing to the contrary.

Howbout doing it the American way? You can google up a source and buy them there. No need to pull out a gun. I'm going to assume you won't put them in your nose or mouth, or swallow them.

Stephanie Thompson is totally, utterly, and irrefutably responsible for the harm that came to her child. Look on the Buckyballs product page and you can see that the warning label printed on the lower right of the page is identical to the one on the left side of the product packaging.
Stephanie Thompson, you gave your child a dangerous item, not intended for use by children, and they were harmed. This is your fault. You are a bad parent. -

Generally if they're within innser-stomach distance from each other, they connect instantly and would pass through the digestive track together since it takes significant force to pinch them apart.
Their safety guidance for medical professionals seems to suggest otherwise:
If more than one magnet was swallowed, it is highly unlikely that they will pass without surgical removal because of their tendency to bind together across membranes.
Radiographs will be definitive and will show small round spheres, linked together in the gastrointestinal tract.
Once the diagnosis is confirmed, urgent surgery is indicated to remove the magnets, repair any tissue damage and treat for infection. Patient follow-up is essential. Do not assume that they will pass through the gastrointestinal tract without treatment.

I have yet to have any adult or child come to the house who could resist playing with them. You make coils rings, try to get them back into a cube. The kids learn about magnetism and polarity but it doesn't scream I'm a science toy and they have fun.On the same theme as set of large ball bearings 10mm or more in diameter are lots of fun but hard to keep track of.

http://www.elenco.com/snapcircuits.html are a bit simplified from the old standby radioshack 150 in 1 kits but are easier for younger children.seamonkeys are still fun though sad when they die.
Gyroscopes are still fun, though good quality ones are hard to find.
A set of rope and pulleys secured to the ceiling are surprisingly fun. It's a crane, it's an elevator for the toy bear, it's whatever the kid comes up with. I was really surprised with how much fun they have with a pulley.
