think they are just a 'bit' slow, they could be making a profit now, for e.g. is music really that much different from porn?, both are available free in huge quantities online, but are the traditional porn companies making more or less money now?
not a perfect comparison i guess as porn works on the internet for reasons irrelevant to the music industry. accurate in that the companies behind both have similar mentalities & methods though.
goodnoise.com has been selling mp3's on the web since way before napster

One thing missing from comments
Ok all, there's lots of good comments here, but one thing missing... links to places to get *legal* MP3s!
GoodNoise - I like this place, they have some free mp3s, plus mp3s at $1/song or $10 for an entire album. They even are set up so if your download is interuppted, you can still go and get the music. They have some good artists, including my personal fave, They Might Be Giants.
MP3.com - I haven't really used this place much, they have a *ton* of mp3s available for download free, but last I checked it was kind've hard to find out who was good and who isn't, this may have improved now though.
Also, if you're an artist, check out D.A.M. (Digital Automatic Music) System . They give you 50% of the sales from CDs! With a non-exclusive contract! I don't make music myself, but this sounds like a really great deal to me.

What's this? An industry honcho with the consumer in mind? The RIAA and the companies it represents should take a lesson from this man. I'm not worried. If people want MP3, it will always be around. Plain and simple. As soon as SDMI starts becoming popular w/ the record companies (and it will) i'll find a cracked player (cracked not to take away from the developer(s), just not to fund the RIAA) and record the SDMI files to wav w/ total recorder as they pass through my soundcard. After all, that's how i've been converting the liquid audio and a2b "secure" foramts all along.

Ubergeek band Poster Children recently left Reprise partly so they could do stuff like this: their new album will be available in stores on CD (including nifty enhanced CD stuff they programmed themselves) or you can pay a small amount and download the whole thing.
And, there's a full-length free track which seems very appropriate for /.ers: 6x6.

Not that exciting.This isn't particularly groundbreaking or anything. Check out Good Noise, where you can download singles (or whole albums, for a small price) from SpinArt artists like Frank Black. And I'm sure others here can put together a decent list of other semi-big-names who have released MP3 singles already.
