Re:...time for a little civil disobediance
Given MediaDefender's own website brags about their cyber-terrorism, I think we'd all be failing in our duty of care to the global internet if we didn't take an axe to all their links. Physical address of their links, please?
-
Full mp3s on their website
After browsing their site, I found this open dir: http://www.mediadefender.com/marketing/ . How is spreading an mp3 of Kanye West or Timbaland legal? Should they now DoS their own webserver?
-
Re:What's sauce for the goose...
I wonder if the NYT knows about this. I see a great big copyright infraction lawsuit coming up with MediaDefender on the wrong side. This could get very entertaining before it's finished.
-
Re:What's sauce for the goose...
Here's something interesting. From their news page, http://www.mediadefender.com/news.html, they are distributing PDF copies of articles from the New York Times and the Wall Street Journal. Not links to those sites, but copies of the articles. Copies of files containing copyrighted content, even though they are not the owners of that content. There's even an article from ARS Technica. Interesting....

Re:What's sauce for the goose...Yeah. Good. Put your IP in the web server logs, with a referrer showing you came from here, knowing that they have been known to perform network attacks. I think it would be interesting if they attacked the telco my dynamic ip belongs to. But somehow I don't think they're going to be looking to dig themselves deeper in shit than they already are.
They've yet to post any spin on this to their news page, but looking at how stale it all is, perhaps they've forgotten they have one. -
From MediaDefender's front page"Our solutions have been adopted as practical, proven methods to thwart Internet piracy and to drive consumers to pay for digitized content distributed through authorized channels" This, fresh from MediaDefender's own homepage.
Racketeering? protection money? WTF? -
Re:What's sauce for the goose...
It looks like they have some decent-sized PDF files.. I mean, some press releases on their site, too!

Successful Campaigns
Is it just me, or is the "Successful Campaigns" mouse-over broken on their marketing page? Ironic...

What's sauce for the goose...
MediaDefender seems to think it's just fine and dandy to DOS other sites because they don't approve of what that site's doing. Why don't we all go over there and take a real good look at what they have to say for themselves. Let's see how they like being Slashdotted.

I wonder...
...if MediaDefender has a license to distribute Wall Street Journal's articles as a PDF from their own site:
http://www.mediadefender.com/news/20070622_WSJ.pdf
It's apparently printed out to PDF from the WSJ website by someone named "randy". It doesn't really look like something they'd get by buying the publication rights from WSJ... -
ironic
I find it funny that a company attempting to stop others from distributing copyrighted works may themselves be doing the same thing.
http://www.mediadefender.com/news/20061018_WSJ.pdf
I assume that if they had paid for reprinting rights for this article, it would be in a different format.
It looks like they may be violating WSJ's copyrights on their own news page. -
Re:Interdiction
.torrent files have a string of "20-byte SHA1 hash values, one per piece" (http://wiki.theory.org/BitTorrentSpecification). It must be a misinterpretation or something, because it sounds like other p2p systems and not BitTorrent. Having read through most of MediaDefender in the News, reporters tend to give unclear or incomplete explanations.

Interdiction
From ARSTechnica article in the "News" section of Mediadefender.com - http://www.mediadefender.com/news/20070318_ARSTechnica.pdf)
Four main methods
Decoying. This, in a nutshell, is the serving of fake files that are generally empty or contain a trailer. The goal is to make legitimate content a needle in a haystack, so MediaDefender works hard to ensure that its copies of files show up in the top ten spots when certain keywords are searched for. Everything about the file is tailored to look like the work of pirates, from the file size (movies are often compressed enough to fit on a CD) to the naming conventions to the pirate scene tag. With massive bandwidth and plenty of servers, the company has little trouble in getting these decoy files to appear at the top of search results, but decoying has a down side: the bandwidth. Because MediaDefender actually serves these large but bogus files, it incurs a significant bandwidth bill by using this technique.
Spoofing. Spoofing sends searchers down dead ends. MediaDefender coders have written their own software that interacts with the various P2P protocols and sends bogus returns to search requests, usually directing people to nonexistent locations. Because most people only look at the top five search results, MediaDefender tries to frustrate their first attempts to download a file in hopes that they will just give up.
Interdiction. While the first two techniques try to prevent searchers from locating files, interdiction prevents distributors from serving them. The tool is generally used when media is leaked or newly released; the goal is to slow its spread in those crucial first days. MediaDefender servers attempt to create constant connections to the files in question, saturating the provider's upstream bandwidth and preventing anyone else from grabbing the data.
Swarming. Though he acknowledges the BitTorrent networks can be hard to disrupt, Lee points out that MediaDefender can use "swarming" to make life more difficult for users trying to download copyrighted content. BitTorrent works by using a hash file to reassemble a file from many pieces, each of which may have been downloaded from a different user. MediaDefender simply serves up its chunks of these files, but instead of providing the proper data, its chunks contain static or nothing at all. When the file is eventually reassembled by the user, it may contain clicks, silent spaces, or odd skips. This can make the viewing/listening experience less pleasurable, but it's most effective with software downloads since even small errors can prevent programs from running. -
Re:Internal illegal sharing site ?
First off, there is absolutely *no* reason to take their word for it at all. MediaDefender and companies like them do this for a living - set up sting sites where "Hey, naive kid, you can legally download movies here that just came out in theater" statements are common. Their only objective is to be able to say that you illegally download copyrighted content. These companies aren't something new - they've been around at the least since FTP was the common way to pirate things, and anybody with more than a passing interest can Google or use Wikipedia to find who/what they are and the underhanded tactics they use, or check their website which clearly states they setup fake downloads and sting sites.
And for people that really don't understand whats going on here. Why would the **AA's go after little old granny down the street who doesn't even have a computer - but then some rogue employee at a corporation uses corporate bandwidth and servers to host a P2P site, why would that corporation not get *any* legal flak at all? -
Haha...ftp://leaksftp.mediadefender.com
WTF? Hacker challenge! ;-)
Strangely enough I got there when going to mediadefender.com, then P2P Marketing (LOL), and then "Successful campaigns". :-S
What a weird name for an FTP though. Note this though:In addition to anti-piracy solutions, MediaDefender also offers a Leak Alert service. Our industry leading Leak Team scours Newsgroups, Usenet, and BitTorrent sites to see what cracked/pirated content has most recently leaked. Upon discovery, MediaDefender will download the leak and either send it or provide a secure ftp login for customers to sample the pirated material.
Maybe it's that FTP? But why would it be linked to like that on their site? -
Re:Laches
While that law may be based on real things on some level, I do not believe it to be true, and I can assure you that the ESA (formerly the IDSA) regularly sends out DMCA notices to remove ROM sites, just as MediaDefender does for other media.
I certainly cannot corroborate the bit about NOA ever giving some kind of 24 hour exemption. If anything, they have invented new restrictions I am unable to verify from copyright law (of course, I must confess that I have not read all of it, it is incredibly long, complex, and I'm probably missing most of the important case law, anyhow, since I don't have WestLaw or any of the other tools needed for proper legal research).
You can see the legal section of ConsoleClassix for some information concerning ROMs (they actually got their info from a real lawyer), but I'm a bit more leery of Nintendo's legal section, as they don't bother to give me references so that I can actually trace down some of the rules they've listed, such as that, to paraphrase, 'game copying devices are illegal AS WELL AS any backup copies made via them, even if they're used as backup copies under USC 117.'
Mind you, I did try to ask legal@nintendo.com exactly how one might exercise their right to make backup copies in light of that. They declined to respond. -
This is great but...
I am sure this is the start of a huge slew of lawsuits. UserFriendly had a strip about this on Sunday. You can view it here. It raises an interesting point. The comic implies that anyone with a big enough footprint can ignore/swat the RIAA if they want.
That said, I think that the banning of the RIAA from networks is a start. Now they need to ban the spoofers and companies like MediaDefender who spend all of their bandwidth downloading files from YOUR computer to keep other people off.
