House Democrats Shelve Net Neutrality Proposal
crimeandpunishment writes "A compromise on net neutrality appears to be as likely as Google and China becoming BFFs. House Democrats have pulled the plug on efforts to work out a compromise among phone, cable, and Internet companies. House Commerce Committee Chairman Henry Waxman, who shelved the proposal late on Wednesday in the face of Republican opposition, said, 'If Congress can't act, the FCC must,' and called this development 'a loss for consumers.' Internet companies and public interest groups say the new regulations are needed to keep phone and cable companies from playing favorites with traffic, while those companies insist they need flexibility so high-bandwidth applications don't slow down their systems." The net neutrality debate seems to have fallen victim to the extreme polarization evident in the larger political culture. -
FCC Asks You To Test Your Broadband Speeds
AnotherUsername writes "The Federal Communications Commission is asking the nation's broadband and smartphone users to use its broadband testing tools to help the feds and consumers know what speeds are actually available, not just promised by the nation's telecoms. At http://www.broadband.gov/, users enter their address and test their broadband download speed, upload speed, latency, and jitter using one of two tests (users can choose to test with the other after one test is complete). The FCC is requiring the street address, as it 'may use this data to analyze broadband quality and availability on a geographic basis' (they promise not to release location data except in the aggregate). The agency is also asking those who live in a broadband 'dead zone' to fill out a report online, call, fax, email, or even send a letter. The announcement comes just six days before the FCC presents the first ever national broadband plan to Congress. Java is necessary to run the test." Lauren Weinstein points out some of the limitations in the FCC's testing methodology. -
FCC May Pry Open the Cable Set-Top Box
awyeah writes "The NY Times reports that the FCC is finally looking into the practice of cable companies requiring use of their set-top boxes to access their digital cable and video on-demand services. The inquiry (PDF) states: 'Consumers can access the Internet using a variety of delivery methods (e.g., wireless, DSL, fiber optics, broadband over powerlines, satellite, and cable) on myriad devices made by hundreds of manufacturers; yet we know of no device available at retail that can access all of an MVPD's services across that MVPD's entire footprint.' Yes, there are a few devices out there — for example CableCARD-enabled TVs, and CableCARD/Tuning Adapter-enabled TiVos and Windows Media Center PCs, but only the cable companies' set-tops can access services other than broadcast TV, such as video-on-demand and pay-per-view. Is it finally time to open these devices and embrace actual standards and competition?" Lauren Weinstein has a cautionary blog post about the world we may be entering if this FCC initiative comes to fruition, which concludes: "I have difficulty seeing how this universe can be made to function effectively in the absence of some sort of regulatory regime to ensure transparency and fairness in situations where the Internet access providers themselves are providing their own content that directly competes with content from the external Internet." -
Hunting the Mythical "Bandwidth Hog"
eldavojohn writes "Benoit Felten, an analyst in Paris, has heard enough of the elusive creature known as the bandwidth hog. Like its cousin the Boogie Man, the 'bandwidth hog' is a tale that ISPs tell their frightened users to keep them in check or to cut off whoever they want to cut off from service. And Felten's calling them out because he's certain that bandwidth hogs don't exist. What's actually happening is the ISPs are selecting the top 5% of users, by volume of bits that move on their wire, and revoking their service, even if they aren't negatively impacting other users. Which means that they are targeting 'heavy users' simply for being 'heavy users.' Felten has thrown down the gauntlet asking for a standardized data set from any telco that he can do statistical analysis on that will allow him to find any evidence of a single outlier ruining the experience for everyone else. Unlikely any telco will take him up on that offer but his point still stands." Felten's challenge is paired with a more technical look at how networks operate, which claims that TCP/IP by its design eliminates the possibility of hogging bandwidth. But Wes Felter corrects that mis-impression in a post to a network neutrality mailing list. -
Network Measurement Tool Detects Reset Packets
kickassweb writes "If you think your ISP is sniffing packets, or worse yet, sending reset packets to stop torrents, there's now a beta Network Measurement Tool to detect them, courtesy of Lauren Weinstein of the Net Neutrality Squad. It's released under the LGPL, and runs under Win2K, XP, and Vista. Quoting: 'While the reset packet detection system included in this release is of interest, NNSquad views this package as more important in the long run as a development base for a broad range of network measurement functionalities and associated communications and analysis efforts.'" -
New Network Neutrality Squad — Users Protecting the Net
Lauren Weinstein writes in to announce the new "Network Neutrality Squad" — NNSquad. Joining PFIR Co-Founders Peter G. Neumann and Weinstein in this announcement are Vinton G. Cerf, Keith Dawson (Slashdot.org), David J. Farber (Carnegie Mellon University), Bob Frankston, Phil Karn (Qualcomm), David P. Reed, Paul Saffo, and Bruce Schneier (BT Counterpane). The Network Neutrality Squad ("NNSquad") is an open-membership, open-source effort, enlisting the Internet's users to help keep the Internet's operations fair and unhindered from unreasonable restrictions. The project's focus includes detection, analysis, and incident reporting of any anticompetitive, discriminatory, or other restrictive actions on the part of Internet service Providers (ISPs) or affiliated entities, such as the blocking or disruptive manipulation of applications, protocols, transmissions, or bandwidth; or other similar behaviors not specifically requested by their customers.
