That was what they called it at the time, and I think I got it in writing. They were just rolling out DSL, so I wouldn't be surprised if they were borrowing terminology from more familiar technologies. (I was working for a network-analysis software company at the time, so I was asking about "committed data rate".)
Some DSL providers apparently still use the CIR terminology.

Maybe you should just send them a friendly letter explaining your problem.
Be sure to check your terms of service first. You don't want to call them and tell them that you are running a server that is against their TOS and get your account canned. More and more ISPs are getting draconian about this sort of thing and won't even blink at canning your account for running a "rogue server". Don't get yourself into trouble. Lots of these companies aren't here to help you - they just want your money.Of course, I would rather that you dumped them altogether for this and found an ISP that encourages folks to run servers and explore, like Omsoft. Far better than giving them your hard earned cahs for something you con't even fully use.

Forgot to post the rates Omsoft charges. Sorry. I pay $52.95 per month for the whole shebang - known to them as "Static IP Address Pricing". Repeat after me (and smile): "No blocked ports"...

You're probably going to get a lot of this particular answer (or at least I hope), but if you live in California Omsoft is incredible. Not only do they allow you to run your own server, they encourage it. They are responsive to user requests and very knowledgable. Sure it's only a DSL connection, but my site's been happy about. Re:old news, Comcast is really sucky lately.Let's take their methods out a few generations. Right now, they are threatening or terminating their top 1% of "bandwidth abusers". Let's assume that these folks consumed 50GB a month in bandwidth. Now that those people are "fixed", the top 1% becomes the folks who consume 45GB. They can go throught the same process next quarter/billing cycle/year. If they keep eliminating the top 1%, then the threshold is constantly getting lower for the other 99% before they get their "warning". If left unchecked, the top 1% could very well end up being someone who has less than modem usage.
Regardless, they now not only have the reputation of being a capped service, but they have become the most unreasonable and vague capped service. Way to fight a PR war guys! Comcast/ATT (they keep passing the broadband and cable properties like a hot potato) have had a captive customer base for so long that they have really lost touch with how to keep those customers, let alone build any customer loyalty. I hope you dump them if you can.
I'm lucky, my DSL ISP lets me host servers, have a static IP and give them a call to say "Hi" for fairly cheap. Before you ask, Omsoft.

Speakeasy is a good provider because they offer a reasonable terms of service without charging "Business Class" prices.
I happen to be a customer of one of the litigants, Om Networks (known to me as Omsoft - the article got the name wrong). Before Omsoft, I was an SBC customer. Like some Speakeasy customers, I went with Omsoft for the business class service at regular rates as well (I have web and e-mail on a static IP). Not only did they offer better customer service than SBC (they are local and I can even go to their offices if I had to) and a Static IP address, but they seem to know how to run a company. SBC made me feel like I was inconveniencing them by being their customer. Every time I had to call SBC (they screwed up the PBX a couple of times), they had this "We wish you wouldn't call us unless we told you to buy something" attitude. It seems SBC doesn't have to care because they will get some of my money whether I like it or not.Omsoft service is a remarkable contrast to SBC and in my opinion worth every penny - even with the SBC price gouge. I got an error from their proxy server and sent an e-mail requesting removal from the proxy. Guess what? They did it and replied to me the same day. Link problems? I just give them a call and we troubleshoot it together - which brings up another point: They don't treat me like an idiot. Run your own server? Omsoft encourages it and sees it as a way for their customers to learn technology. It's like having a local "mom and pop" ISP again. I value Omsoft and would be pretty disturbed if SBC ran them out of business with price gouging tactics. I think I'll give my ISP a call tonight to congradulate and encourage them.
