Lobbyists Demonize 'Right To Repair' Legislation (securityledger.com)
"New Hampshire lawmakers got an early taste last week of the arguments that manufacturing, technology and telecommunications lobbyists will use to try to hobble and defeat right to repair legislation in 16 states this year," writes long-time Slashdot reader chicksdaddy.
The Security Ledger reports: Curious children could find themselves dismembered by run-away washing machines. A phalanx of illegally modified lawn tractors and leaf blowers will belch pollution in defiance of the EPA, darkening the sky... At least, that's the scene painted by representatives from some of the U.S.'s biggest industry groups. At a hearing before the New Hampshire House of Representatives Committee on Commerce and Consumer Affairs February 5, they painted a dire picture of the consequences of passing a proposed Digital Fair Repair Act, HB 462, saying the proposed legislation would stifle commerce, leave New Hampshire consumers vulnerable to cyber crime and even physical harm at the hands of clueless owners and inexperienced or unethical repair professionals.
"There is a lot at stake when it comes to Right to Repair, and you could feel those stakes in the room," wrote Nathan Proctor, the head of the right to repair campaign at the U.S. Public Interest Research Group (PIRG), in an email statement. "Legislators have their work cut out for them sifting through all the frantic opposition and their deceptive, and at times bizarre, arguments," he wrote.
HB 462 would require original equipment manufacturers that do business in New Hampshire to make the same documentation, parts and tools available to device owners and independent repair professionals as they make available to their licensed or "authorized" repair professionals. Similarly, documentation, tools, and parts needed to reset product (software) locks or digital right management functions following maintenance and repair would also need to be made available to owners and independent repair professionals on "fair and reasonable terms." -
45 Out of 50 Electronics Companies Illegally Void Warranties After Independent Repair, Sting Operation Finds (vice.com)
U.S. PIRG -- a non-profit that uses grassroots methods to advocate for political change -- found that 90 percent of manufacturers it contacted claimed that a third party repair would void its warranty. "PIRG researched the warranty information of 50 companies in the Association of Home Appliance Manufacturers (AHAM) -- an industry group of notorious for lobbying to protect is repair monopolies -- and found that 45 of them claimed independent repair would void their warranty," Motherboard reports. From the report: PIRG poured over the documentation for 50 companies such as Bissell, Whirlpool, and Panasonic to document their warranty policies. When it couldn't find clear language about warranty and repair, it reached out to the companies via their customer service lines. The overwhelming majority of the companies told PIRG that independent repair would void the warranty.
The 1975 Magnuson-Moss Warranty Act states that no manufacturer who charges more than $5 for a product can put repair restrictions on a product they're offering a warranty on. In May, the U.S. Federal Trade Commission sent warning letters to Sony, Microsoft, Nintendo, HTC, Hyundai, and ASUS for violating the act by threatening to void the warranties of customers who repaired their own devices. Within 30 days, many of the companies had complied and changed the language on their websites around independent repair. It was a step in the right direction, but the PIRGs survey of the AHAM members shows that there's still a lot of work to do. -

A 17-Year-Old Has Become Michigan's Leading Right To Repair Advocate (vice.com)
An anonymous reader quotes a report from Motherboard: Surya Raghavendran of Ann Arbor, Michigan isn't your average 17-year-old. Not only does the high school senior run a small business repairing iPhones when he's not in class, but he's raising awareness about people's right to fix their own devices without paying companies like Apple exorbitant fees. "People should be able to choose where they want to get their devices repaired," Raghavendran told me over the phone. "Right to repair will decrease the amount of e-waste and people will retain their devices much longer with suitable repair networks." Raghavendran is doing more than just talking about right to repair, he's become one of the leading advocates for a right to repair law in the state by pushing his lawmakers to introduce legislation that would protect a consumer's right to repair.
Raghavendran started researching the laws around repairing electronics, and he joined up with Environment Michigan -- an environmental activist group -- and started going to Lansing, the state capitol, to ask politicians what they were doing to protect people's right to repair their own devices. Raghavendran sent an email to state senator Rebekah Warren who called him in for a meeting and told him to start a petition. Since July, he's been asking for stories from the public about why the right to repair is important. The right to repair fight is happening all across the country at the local level and Raghavendran's petition has drawn support from people like like Nathan Proctor, the Director of the Campaign for the Right to Repair at US PIRG. Repair.org, a group pushing for right to repair laws all over the country, has draft legislation it wants to get in front of Michigan's state legislature. Proctor has been working with Raghavendran, Environment Michigan, and Michigan legislators to draft right to repair legislation. Proctor wants to pass a right to repair bill that is similar to the one passed in Massachusetts that forced automotive companies to share diagnostic information with third party repair shops. The law passed in 2012 "set a precedent and the industry rolled out the changes nationally," reports Motherboard. -
As Gas Prices Soar So Does City Biking
Hugh Pickens writes "As California's gas prices hit record highs, the millions of dollars spent in recent years on commuter bike lanes and public transportation projects in Los Angeles, San Francisco and other major cities are being seen in a new light by many drivers. Jason Dearen reports that San Francisco is seeing a 71-percent increase in cyclists in the past five years, and Los Angeles is reporting a 32 percent increase from 2009-2011. Both findings gibe with the U.S. Census Bureau's American Community Survey, which found a 63 percent increase in bicycle commuters from 2000 to 2010 in the nation's 70 largest cities. 'In some ways it's a perfect storm of events that is starting to take place,' says Claire Bowin, head of policy planning for Los Angeles' planning department. Getting people out of cars 'is a very daunting task, but on other hand we have largely benefited from a growing community here that is demanding these things.' Los Angeles is building almost 1,600 miles of bike infrastructure (PDF) over the next five years. Los Angeles County's Metrolink, which features open train cars for bike riders is seeing record ridership. Changing attitudes about cars — caused by climate change — are helping these efforts as people in their twenties and thirties have adopted biking in larger numbers than previous generations (PDF)." -
Privacy Groups Want Feds To Investigate Targeted Ads
ciscoguy01 tips news that three privacy groups are asking the US Federal Trade Commission to investigate whether ad networks are "unfairly tracking Americans and profiting from their data." According to Wired, "Companies named in the complaint (PDF) include Google, Yahoo, PubMatic, TARGUSinfo, MediaMath, eXelate, Rubicon Project, AppNexus, and Rocket Fuel. At issue is a growing market of targeted, real-time ads, where advertisers can choose to show ads to people based on their age, gender, income and location — as well as their recent online behavior — often on unrelated sites that let third parties track users.... Third-party cookie tracking isn't new, but as the complaint points out, marketers are increasingly trying to augment that data with other data sets, such as the social network data that Rapleaf harvests and resells.... Tying ad cookies to personally identifiable data would let marketers successfully combine online and offline data on website visitors to build a complete digital dossier on a user."
