Brazil Breaks Patent to Make AIDS Drug
Andy Tai writes: "In this CNN story, Brazil decides to break a patent over an AIDS drug for public benefits. Brazil will produce the drug domestically without agreements with patent holder, the Swiss pharmaceutical company Roche. Brazil's efforts to fight AIDS have been praised internationally, and it successfully prevented the US Government from bringing complaints in the WTO on behalf of the drugs industry. This may set an important example that public needs justify the disregard of patent protection." There's another article in the Boston Globe about the decision.

Patents == People Dying of AIDS
Spoken like somone who has no idea how drugs are made. I work at a company who does monitoring for pharmaceutical research (hence my being AC), and it costs billions (that's right, with a B) to get a drug to market. First you have to research the drug to come up with something that might work. Then there are at least 3 phases of studies that all drugs must go through. These involve having hundreds or thousands of patients take the drug to study whether it is safe, whether it works, and how well it works. Now, the drug company has to pay not only the patients in the studies, but the sites that conduct the studies, companies like mine that monitor the study to make sure everything is done correctly, for people to collect the data, people to clean the data up because the sites messed things up, people to analyze the data, and people to write reports based on the analysis to go to the government. This is a process that takes at least 5 years. And 90% of drugs never make it through. For every drug you see advertised, there are 100 that the company spent millions of dollars each on that never got approved, that are nothing but a loss. So you can talk about how drugs shouldn't be patented, but without the ability to make back the money they spent not only on that drugs, but the others that never got approved, there would be no new drugs. Hell, it's barely feasible for most companies to research new drugs now, it wouldn't be feasible for ANY company to research new drugs if they didn't have a patent on it.

There have been world threatening plagues as long as we've had an industrial society.
One hundred years ago there was syphilis, which was just as incurable as AIDS. There were dozens of other incurable diseases.
The 'spectre of AIDS' is not a new thing. Such threats have been a part of human culture forever.
So let's stop trying to pretend 'we have to pull all the stops out, the rules must all change.'
I'm not trying to minimize the threat that AIDS represents. I am trying to prevent certain people from using that threat to their advantage.

Besides governments fund the research and universities which create the research these drugs are based off. Even if they didn't, so what. Medicine does NOT need a profit motive. If you refuse to believe that, think of all the money you make by not dying as profit.
