Can Copyright Apply to SPAM?

Archive received a legal threat today. A
'lawyer' claims that some spam displayed at the
site is copyright, and must be removed.
I'm claiming it's fair use for me to display
an unwanted email sent to thousands (probably millions)
of people at random. Is this fair use, or do they
really have a case?"
DEAR GENTLE SIRS--
I am a biology professor at a university whose name I may not disclose due to representation laws and Internet usage guidelines of the school and have been studying crayfish and marine lobsters extensively for the past decade. I sepcialize in prehistoric cray physiology and breeding patterns of modern crays.
I have recently intiated a hybridization program at the school's lab, utilizing oronectes and procambarus spp. So far success has been abysmal, with 0% success rate between any members of differing genus; however, we have had some berries grow and then mysteriously shrivel between parents of similar genus.
I am wondering who else has attempted crayfish hybridization and if so, with what genus, species, and methods of fertilization.
