Is ROM Collecting Wrong, or Just Misunderstood?

The various writers at Game Bunker do a good job of showing the different sides of this issue, with some siding with industry while others, like most of us, merely want to play old games without having to dig up an ancient console.
Lets compare this to satellite signal theft. There's a big debate raging on the Canadian west coast about people ripping off DirecTV signals. Now, Canadian law (I'm not sure about American) states that as long as a company could reasonably supply a given population with a broadcast service, but fails to do so, the people of that population are not breaking the law by acquiring the signals through a means other than the company providing it.
So, using precedent and the same logic, could you not say that if the game or system is simply unavailable for purchase, is it not therefore 'legal' to acquire it through the only means available to you (ROMs)?
