      Thanks... I was trying to figure out whether this was the EFF lawyer I saw make an ass of herself on CNN a few weeks ago defending file sharing, and it was.

      I have to say, I always thought that being a lawyer required a modicum of public speaking skills, but she has none. She stuttered incoherently for a couple of minutes and made the RIAA guy look good.

    # Who is Wendy Seltzer?

    I'm now a staff attorney with the Electronic Frontier Foundation, and a Fellow with the Berkman Center for Internet & Society (which Greplaw readers might know as the wacky and wonderful institution that hosts Greplaw). I spent lots of time programming and thinking about Internet technology in law school, as the Berkman Center's first general-purpose tech, and that experience deepened my concern that bad tech regulation could choke the very speech that the Internet enables.

    # Some Greplaw readers may not know about the Electronic Frontier Foundation (EFF). Can you please give a brief presentation of the EFF?

    EFF is a non-profit public interest organization fighting for free expression and civil liberties in the digital age. As an organization, we stay on the front lines of new technology, watching for places where the code and law collide. We try to ensure that individual freedoms survive the collision, so the rights we've enjoyed offline persist into the online world.

    # What do you do as a EFF staff attorney?

    I focus on intellectual property and fair use, spending lots of time explaining why copyright's overbreadth is a free speech issue. For example, I've been fighting the Digital Millennium Copyright Act, in an amicus brief of behalf of 321 Studios (makers of DVD X-Copy, which enables archival and personal-use copying of DVDs), protecting reverse engineering (BNETD and Lexmark v. Static Control), and working to preserve Internet users' rights against overbearing copyright claimants (amicus supporting Verizon's fight for its customers' privacy in RIAA v. Verizon). I've also been encouraging other participants, such as universities and ISPs, to take more active roles on behalf of their students and customers.

    # How did your friends react when you left your hot-shot lawyer career at Kramer Levin Naftalis & Frankel to protect civil liberties on the Internet?

    The better they knew me, the less surprised they were. Kramer Levin was extraordinarily supportive of my pro bono work with the Berkman Center, but it became clear that I wanted to be fighting the public-interest battles more than just part time.

    # What are the most important current challenges to the freedom of the Internet?

    Even though I spend a lot of time on copyright and "intellectual property," I'd have to say that the biggest threats right now come from allowing government's cries of "terrorism" to erode our Constitutional rights to privacy, free speech, free association, and due process. Online, that translates into Carnivore boxes, secret wiretaps, and draconian cybercrime sentences. I'm encouraged that politicians in both parties now seem more willing to challenge the official line that the public must give up its rights "for our own good." These rights are what we're fighting for in the first place.

    # Professor Lessig and others seem to think that the sky is falling over the Internet. Are you as pessimistic about the future?

    I'm somewhat optimistic that in the long term, we'll restore balance to technology regulation, but I'm still pessimistic in the short term. And the short term might last a long time.

    # Why?

    It takes a long time to teach the judges, legislators, and public to understand technology. Right now, they're getting a strong dose of "education" on the Internet's threats and harms, and not hearing so much about its potential. Shouts of "piracy" often outweigh consideration of how we might communicate with more open media formats, but judges like Stephen Wilson in the Grokster case are starting to listen through the shouting. We're encouraging more people to think about how the law shapes technological innovation, how the technology itself can foster creativity, and then to do something about it to advance the public interest.

    # How could Greplaw readers help the EFF, except for obviously donating to the EFF?

    A lawyer with coding experience. Very nice selection for the EFF. She certainly seems to a very good perspective, based on the interview.

    I would think her background would give her a decided advantage in court against opposition such as SCO's legal team. Non-technical lawyers I'd expect would be rather limited in their ability to see the proverbial trees as well as the forest, leading to egregious, easily-destroyable assertions such as SCO's claim that, in effect, "Linux" is one particular whole, when a moment's consideration from one with a technical background would suggest it's actually a very dynamic, variable thing, and that to claim all Linux deployments violate a given set of supposed "infringments" is rather absurd.

    I'd expect Ms. Seltzer will be able to bring good arguments to the table on this and many other Open Source challenges. Kudos to the EFF's fine choice.

    How about focusing on "equal oppertunities" instead, and hire the best person for the job, with no regard to gender, skincolour, cultural background or religion? I'm sure that will work out better, while at the same time makeing sure the rest of us don't have to hear people whine about how the new co-worker was hired just because she sits down when she pees (instead of standing up, like most guys do).

    Just my 2 cents.

    Seltzer used to be quite active on a couple of mailing lists dedicated to preparing legal briefs in a Universal v. Remierdes Eldred v Ashcroft and similar legal cases.The lists were (and still are) idealistic and noisy, but the legal discussion (archived by Lexis-Nexis at one point) was a lot of fun.

    As it happens too often here, the editor allowed through a story that is plagiarized. The submitted text was cribbed verbatim from the site (the gratuitous addition of links do not excuse the crime), which fit the definition of plagiarism to a tee.

    If one cannot bother to paraphrase, then perhaps one might consider deferring one's submission, as a courtesy to the original author. After all, some folks work hard to craft the words that we enjoy reading. Why not provide them the common courtesy of respecting their hard work?

      For the sake of argument, I'll assume that your account here and on Greplaw are the same person. That being the case it wouldn't necessarily be plagiarism (depends upon either sites' policy), but as a courtesy to your readers, it would have been helpful to have some sort of disclaimer, or words to the effect of "As I mentioned in my post at Greplaw..."

      In effect, you crossposted and you didn't add any value to the post here. Why even post the link to GrepLaw, when you could've crossposted the entire article (the Q&A) here?

      There is only one of us and that's me. Your point is null and void since one can not plagiarize oneself. I could be in breach of contract should I have promised to Greplaw to not submit the intro to any other website (which I have not), but one can never plagiarize oneself.

      Since you have falsely accused me of plagiarism I have a hard time taking lessons from you on 'courtesy', but I will be a good sport and I will try to rephrase my future submissions to Slashdot if others agree with your position.

    Then they came for the unskilled laborer jobs. I never spoke out because I wasn't an unskilled laborer.

Now, instead of the most valuable person for the job, companies are obliged to employ rancid, workshy immigrants.

    Of course, the animals want to get into good companies, so they in turn can influence management decisions to outsource further jobs to their cousins overseas. Thus destroying an entire nation.

    From the lowliest Janitor to the highest executive, foreigners MUST be eliminated from our corporations.

    You can't solve the social problem of sexism/racism with this, although it *sounds* ideal. People are born into categories that are inequal, and equal opportunities aren't enough to give them what they deserve - a fair chance.
    I know that as a white male I'll gladly give up my spot at the state univ. if it will mean the university becomes less segregated. Then and only then, after the situation of unequal footing due to race/sex has been improved through getting to know people of other backgrounds more personally, we can say an equal opportunity is enough.
