Dutch Court Rules That Linking Is Legal In Scientology Case

touretzky writes "The Court of Appeal in The Hague today rejected all of Scientology's claims in appeal in Scientology's action against XS4ALL, Karin Spaink and ten other internet providers. As a result, Karin Spaink's website, which Scientology sought to remove from the Internet based on copyright claims, is entirely legal in the Netherlands. The court also overturned two lower court rulings, one of which said that linking to material that infringed a copyright was itself actionable. The other ruling said that ISPs that failed to act on credible notification of a copyright violation could be held liable for that. The Appeals Court felt that this was too vague a standard, and thus posed a threat to free speech. More info at ScientologyWatch.org."

    Is this: "creation" of a rich japanese individual who claims was buddah in his "previous life"..
    "Membership" in that "cult" requires purchase/reading of at least 10 books written by this "individual", each book being fairly expensive, not something you'd call pocket change, anyhow.
    Main focuses of this "religious cult" are on "research of happiness", which is just bullshit excuse for "suck in as many members while taking all their money" kind of thing.

    Because japanese people in general are quite gullible, the group has been able to attract huge numbers of "members" who are required to buy more books, materials, and visit the churches built by the cult in order to generate more money for Ookawa Ryuho, ths cult's founder.

    In response to your sig, I feel that claims of racism are thrown around way too freely today. For example, I've had people label me a racist because I oppose affirmative action. If you don't know, affirmative action gives preferential treatment to minorities instead of treating everyone equally. That is discrimination, too, even though it's not done against a minority. When people use the term racism as freely as they do, it's only natural to be defensive about it, because in a world where it's just not cool to be a racist, nobody wants to be labeled a racist. Even if they're not actually a racist.

    GPL is a defensive copyright.

    if we abolished all copyright (and patents) completely then we wouldn't need GPL.

    Therefore it is not inconsistent to be against copyright and for GPL copyleft.

    Racism, unlike WMD, is a very specific thing, and it has nothing to do with eliminating relatively unfair discrimination. Racism is about systematic attempts to deprive a particular race of people positions of power in society.

    Since you have no idea what racism means, and then redefine racism so that you're not actually a racist, you are ignorant, and so you probably are a racist.

    RIAA helps Bust Mad G Thug Money

    In a surprising turn of events today, it appears that the RIAA is actualy the hero. They have given information over to the authorities to aid in the capture of legendary crime lord Mad "G Thug" Money, who was using the peer to peer file sharing client Kazza Lite to send mesages to his underlings. He was apparently making music, under the name of Jewish Nazi Mafia Fucka, which were altered to contain morse code signals. The typical message tended to be one of three things:
    • 1. To Transmit gps locations of orange trees on floating islands in the pacific sea
    • 2. Transmit requisitions for live albino hamsters
    • 3. Complain about how the "Gay Nigger Association of America wanz to git maye BITCHES"

    The official press release from the RIAA states that investigators had become aware of the material when a former ceo of SCO, who is currently working with them on litigation target aquirement, apparently deciphered the messages. When asked how he did it, the ex-ceo stated: "I was up late, smoking cra--, a blun--, no, I mean I was, oh fuck...."

    The Public Relation department of SCO has officaly commeted that they have no comment on this matter. They are quoted as saying: "G Thug isn't stealing our IP, so we have nothing to say on this matter. As for those dirty linux hippy fucks out there, just remember when you run the linux Kernel, you are stealing food from the plates of some software engineers that we fired a couple decades. How can you bitches sleep at night?"

    A local television station landed an exclusive interview with "G Thug." which gave us all a glimpse into the mental workings of Mad "G Thug" Money. Excerpts of the transcript follow:

    Reporter: Would you prefer to be called Mr. Money or G Thug?
    MGTM: U c@n callz meh teh slaped down lick teh biatch in da frockin pan, like a p3t3r p@n slap! GO LINUX!

    It is expected that testimony from a close personal friend and linux guru Mad Dog is going to testify on Mad Money's behalf.

    When asked for a comment, Corey Feldmen said that "The GNAA's days are numbered."

    How did I know some ignorant Slashbot would come along and call me a racist.

    From dictionary.com, racism is either a belief that one race is superior and that "race accounts for differences in human character and ability" or "discrimination or prejudice based on race." What I discussed was the second definition of racism, it's one that most people understand to be racism, and it's in the dictionary.

    There's no requirement for racism to be systematic, organized, or intentional. For example, not interviewing minority candidates for a job would be considered racism. A waiter in a restaurant, even without thinking about it, seating a minority family towards the back could be considered racism. And what do you think the term "racial slur" means, if it's not about racism?

    I take the issue of race very seriously and we ought to understand it for what it is. That means not being afraid to call something racism when it is, and not mis-using the term on something that isn't racism.

    My point still stands.
