    It is an error. The MVP only allows hardware decoding. However, there is no reason why one couldn't fit an appropriate PCI card to allow hardware encoding too.

    I own a small development shop. Here is how I handle it -

    (1) Build a static library containing the GPL'd code you want.
    (2) Link against it.
    (3) Don't tell anyone what you did and claim the code is 100% yours.
    (4) Profit!!
