From the article: 'At the store, someone buying a new DVD would have to provide a password or some kind of biometric data, like a fingerprint or iris scan, which would be added to the DVD's RFID tag. Then, when the DVD was popped into a specially equipped DVD player, the viewer would be required to re-enter the data.'"
I don't see why a machine has to let you "enact fair-use." Certainly you can't be sued or charged for actions that fall under fair use but does that mean the technology provider has to make the process easy for you? Should television producers be required to provide you with a vcr so you can time shift? Does every CD have to come with an mp3 player and a computer since moving music to an mp3 player falls under fair use? I could go on.
The point is there are a lot of things in this world that are not illegal but someone is not obliged to make it easy for you to do it.
If we are both in a bar you would be well with in your rights to bore me with you life story (try to sue someone for talking to you and for being boring) but I can still wear ear plugs.
