Apple Changes the APSL Rules

According to semthex's post, Apple has reworded the APSL to prevent him and others from open sourcing the kernel hacking under the APSL: 'This file contains Original Code and/or Modifications of Original Code as defined in and that are subject to the Apple Public Source License Version 2.0 (the 'License'). You may not use this file except in compliance with the License. The rights granted to you under the License may not be used to create, or enable the creation or redistribution of, unlawful or unlicensed copies of an Apple operating system, or to circumvent, violate, or enable the circumvention or violation of, any terms of an Apple operating system software license agreement.'"

Yeah, why doesn't Apple just release its kernel under the GPL like Microsoft? Oh wait.

They're being pretty damn generous even letting you see the source code. If you don't like the license, don't view the source, it's not necissary.

Darwin is no longer Open Source

People are missing an important fact here: Darwin is no longer Open Source under the Open Source Definition:

  The license must allow modifications and derived works, and must allow them to be distributed under the same terms as the license of the original software.

  The license must not discriminate against any person or group of persons.

  The license must not restrict anyone from making use of the program in a specific field of endeavor. For example, it may not restrict the program from being used in a business, or from being used for genetic research.
