Strip-Search Case Tests Limits of 4th Amendment
langelgjm writes "The US Supreme Court has agreed to review a case involving the strip-searching of a 13 year-old girl who was accused of possessing prescription-strength ibuprofen on school grounds, in violation of the school's zero-tolerance drug policy. The case has gained national attention because of the defining role it will play in determining which, if any, parts of the Constitution apply on school grounds. In Morse v. Frederick, the Supreme Court has already upheld the right of school administrators to restrict students' free speech at school-sponsored events that take place off school property. The school described the strip-search as 'not excessively intrusive in light of [the student's] age and sex and the nature of her suspected infraction.' The Supreme Court's last decision about searches on school property dealt only with searching a student's purse. Incidentally, the girl was found not to be in possession of any drugs, illegal or otherwise."
This man is a traitor and should be sacked for treason. There are countless things his government has already done tht exceed the limitations of POWER in the US constitution. He is so bad, that not even "ICC" or "General Welfare" clauses can be used to justify this monster's actions. Its horrible.

I travel a lot for business and have lived as an expatriate, All over Europe, in China, in Korea and Eastern Europe. America has major problems but I'm always glad to come home (please, don't tell me health care is better in Europe, please.) With Bush in charge, the reckless spending was annoying. I figured that Obama couldn't be worse than Bush. I was dead wrong. Actually, come to think of it, isn't this exactly what that part of your constitution about carrying guns is for?
No. The Second Amendment of our Constitution guarantees the slave states the right to quickly put down slave uprisings on their own (with a "militia"), rather than wait for the National Guard or the Federal Army to intervene.
I'm not denying the existence of Foundational rhetoric purporting a right to bear arms as a check against tyranny. But as a practical matter, it was about slavery. Quite ironic, actually.
Ask yourself this: How many times were arms used to fight the tyranny of the government? There are a few historical examples (Whiskey Rebellion, Civil War, Wounded Knee) but they are few and far between -- and, to date, unsuccessful. Now, for how many years were privately-held guns used to keep slaves in check? You are invited to "do the math."
The purpose of the Second Amendment was to allow slavery to continue unencumbered, despite the regulatory and military power of the new Federal government. Any other explanation (and the accompanying rhetoric) is window dressing.
It's willful ignorance to suppose that the Founding Fathers recognized the necessity of firearms to prevent tyranny, but didn't acknowledge their role in maintaining slavery.

Look, I don't disagree that without an armed citizenry some Federal power might have swooped down and brought injustice. But it should be obvious that without armed slaveholders, slavery itself would simply have been unworkable. Thus, the right to bear arms was in fact a concession to the South. Without the Second Amendment, Congress could have de facto ended slavery simply by outlawing personal possession of firearms. It was this concern on the part of the slave states that led the amendment to be drafted in the first place.
Then, to sell it to the whole, they came up with the rhetoric you espouse, that it protects us from tyranny.
Where was that protection from tyranny during the Whiskey Rebellion? Why do you continue to believe it's about protection from tyranny when the armed populous was crushed by the Federal government as early as 1791?
When you're the guardian for a child which could have enough meds to be lethal there's no time to fuck around for a judge to issue a warrant. If your child has a bunch of pills scattered around it are you going to call a judge to see if you can get a warrant to see if it took any?

Not suspected of trafficing illegal drugs? Yes she was, the drugs were prohibited for her to have in the school, she was suspected of exactly that.
I roundly reject the idea that this should be treated as some special case. Either they have the authority to prohibit this sort of activity, or they don't. Period.
I love this case because it tests peoples feelings on the issue. Yes... this is what drug laws mean. Once you start, this is the conclusion. Enjoy the world this social experiment called prohibition has created.

Your argument was that the teachers needed to go to a "competant authority" (not sure what authority that is exactly).
My point was that the teachers are the guardians of the children while they're in school, and when it's known that a group of 13 year old friends have enough drugs to kill themselves most parents (that aren't looking for some quick cash from the public schools) would want the drugs to be found asap
If it's serious and no-one is turning up the drugs better to play it safe than deal with a suicide (or is it better? with cases like this the clear answer is no, they should have been left to do what they like with their drugs)
I don't know who could go up to the female teachers who searched her 6 years ago, without touching her or getting her to take her clothes off, and call them child molesters. I think people are judging the situation with gut reactions3

The purpose of the Second Amendment is very simple. Once the American Revolution was underway, King George's generals were confiscating weapons from the Colonials. The right to bear arms is expressly for a well-organized militia to repel the British. Anything else is window dressing.

The Second Amendment was very clear on the reason why. It's just that the first part of that sentence is always ignored.
