He's not in any trouble. He's one of the 4.3 billion people who lives in a country with "bad" IP laws.
There's ton's of copyright infringing material all over the net. Check out Super Mario Bros Z or a simple google search. Most of them are well done, but I'm sure no-one asked Nintendo or Sega if it was okay.

Yeah, I also noticed that you can play as other characters besides Mario & Luigi which were _definitely_ not in the original. Also, there seems to be some pixels out of place in the castle, I haven't finished counting the bricks but I'll let you know when I do.
