EPA Reverses Course on Ozone Rule (nytimes.com)

The Trump administration said late Wednesday that it would not delay an Obama-era regulation on smog-forming pollutants from smokestacks and tailpipes (Editor's note: the link could be paywalled; alternative source), a move that environmental groups hailed as a victory. From a report: The Environmental Protection Agency decision came a day after 16 state attorneys general, all Democrats, filed a lawsuit challenging the delay with the United States Court of Appeals for the District of Columbia. It reversed a decision that Scott Pruitt, the E.P.A. administrator, made in June to put off an Oct. 1 deadline for designating which areas of the country met new ozone standards. In announcing the ozone policy change, the agency appeared to leave the door open to extending the deadline again. But, officials said, the agency will work with states to help them deliver the needed information.

    If the hairstyle is disturbed, I am conscious of correcting immediately. The disturbed hairstyle leads to disorder of the heart. It's not cool. "J" to be hardened in ultra hard is my partner from now. One of my good skills is that there is a technique called "summer salt kick" that kicks backward while somersaulting. I would be happy if you knew it .... Even using it several times, the hairstyle was stable. Hair style is also my own heart itself.

      Evidence of "trying"?

      Trump has consistently presented Climate Change specifically as a waste of money and competitiveness, coupling that with stated intention to focus resources on clearer problems, like standard types of environmental pollution.

    The next generation of cars will solve this problem. Heard Musk is working on the prototype for a coal powered car as well. Clean American coal will provide the power for electric and coal fired vehicles, solving the pollution problems caused by petroleum.

      The submitter gets money for linking to a site, from that site. Either because the submitter works for the site, or because the submitter has some other association with the site such as being the author of the article.

      Sure, if you think of Conservatism as being fiscally conservative or environmentally conservative (which 'Conservatives' used to espouse).

      These days, Conservative has been taken to mean 'Advance Corporate Profits at ALL COSTS', which means that any attempt to reduce pollution is an attempt to increase costs on corporations, so they are BAAAAAD

    No one likes smokestacks or tailpipes. I bet if there were a fan club for smokestacks and tailpipes, it would have very few members. And only a few mothers ever say to themselves "I hope my son grows up to be a smokestack or a tailpipe."

    In short, I think most people are okay with these regulations.

      Shipping companies are generally pretty keen on green/fuel efficient vehicles (less for environmental considerations and more for financial ones of course). UPS, Fedex & USPS currently have thousands of various hybrid/electric vehicles on the roads with plans for MANY more in the next few years.

      They do seem like ideal use cases, at least around town. DHL goes out pretty far... but most USPS vehicles drive their route, make a bunch of stops along the way, and come home and sit overnight. I'm sure they'll appreciate the mechanical simplicity.

    Wrong.
    The states can indeed get a court to compel Trump to act in accord with the law and require "Best technology" to abate a danger, as spelled out in the clean air act.

      You are right and wrong at the same time.

      Executive orders are used by the President to dictate administrative policy. For example, the EPA only exists because Congress abdicated its responsibility to write environmental law and instead just uniformly delegated that power to the Executive branch, and placed the whole of environmental custody under unaccountable administrative law (these are non-criminal regulations for which there is no due process).

      The President can then use that delegated power to dictate policy. He can write an XO directing the EPA to adopt a particular policy through its normal rulemaking progress. There is nothing in the law that says the EPA has to bend to public comment - only that it must collect and consider it.

      Trump absolutely can direct the EPA to adopt new regulations, but what he can't do is shortcut the adoption process, which takes time. That's what these lawsuits were over. The President can't unilaterally change the rules without going through the approval process that Congress mandated in the original delegation of power.

      At the end of the day, Trump and his EPA absolutely can rule by decree. That's the definition of a delegation of power. The only obstacle is the time it takes to go through the approval process.

    Why do stories have to have headlines for everything like it's a military battle or sporting event? It's no wonder so many have become combative in recent times. I'm sure it's always been this way to some extent, it just seems so over the top and never ending these days.

    At this rate I expect the headline for a story like this in ten years to be "Environmental groups declared this a hard fought bloody victory against those who torture and maim baby fur seals and puppies"

    Of course on the other side they will claim, "The dirty cavemen have descended on your city like murderous vikings to pillage your hard earned money and rape your pets"

    Wrong.

    A State can't just use any court to compel a specific desired action from the Executive branch.

    They'd have to take it up with a federal court, and it would ultimately be decided by the Supreme Court, and all they still can't compel Trump to do anything specifically. They'd declare what Trump's administration did or didn't do to be legal or not, and it would be up to Congress to create new laws, the EPA to act within those laws and their charter, and/or Trump's administration to do something else (or not) in a fashion that jibes with (or skirts) the Supreme Court's ruling.

    If they are indeed designed and made there then that is good for the Californian economy. Why would that be a pity? The owner (the federal government) ships most of them out once they are finished. All factors of the supply chain for nukes are pretty much moot points. Just like it is a moot point that four of the five largest military bases in the world are in red states (North Carolina, Kentucky, Texas, Georgia). In fact the majority of the other US military bases are also in red states - but it's a moot point. It just doesn't matter.

    He isn't a fascist for being willing to fight, wanting his opposition to pick a fight, or dreaming of winning the imaginary fight. That's not what fascism is.

    Well, first of all, Federal Courts exist precisely to give people remedy when the Government won't enforce existing laws, so he's wrong on that front. And even if he was right, if an Administration refuses to enforce one set of laws, how precisely does passing even more laws remedy the situation? So he's just being absurd on that point.
