Fed Up With Apple's Policies, App Developers Form a 'Union' (wired.com)

Even as Apple has addressed some of the concerns outlined by iOS developers in the recent years, many say it's not enough. As the iOS App Store approaches its tenth anniversary, some app developers are still arguing for better App Store policies, ones that they say will allow them to make a better living as independent app makers. On Friday, a small group of developers, including one who recently made a feature-length film about the App Store and app culture, are forming a union to lobby for just that. From a report: In an open letter to Apple that published this morning, a group identifying themselves as The Developers Union wrote that "it's been difficult for developers to earn a living by writing software" built on Apple's existing values. The group then asked Apple to allow free trials for apps, which would give customers "the chance to experience our work for themselves, before they have to commit to making a purchase."

The grassroots effort is being lead by Jake Schumacher, the director of App: The Human Story; software developer Roger Ogden and product designer Loren Morris, who both worked for a timesheet app that was acquired last year; and Brent Simmons, a veteran developer who has made apps like NetNewsWire, MarsEdit, and Vesper, which he co-created with respected Apple blogger John Gruber.

      Apple definitely cares about sales through their store. The question is whether the apps in question represent enough $ to matter.

      If they are "app developers" then their livelihood and entire career depends on app sales. It would hurt them way more than it would hurt Apple, because unlike an employee union - you can't just find another employer. Apple has all the leverage, even still.

      not just current amount of money in them... but if they are actually alone in their audience. Even if an app pulled in 2 million dollars a week, most of them would pretty quickly get replaced by a competitor the second they vanished from the app store.

      Both have a lot to lose, and Apple could very well lose the most if enough devs are serious about this. Potential competitors of apps that pull out could refuse to take their place to put pressure on Apple. And we've seen what a platform becomes when developers avoid it with UWP and the Microsoft Store.

      The thing is, if these are independent developers, how much does their voice really matter. What percentage of app store downloads do these folks represent, vs the number of downloads of apps from larger corporations. There are a lot of apps on the store that could vanish tomorrow and nobody would even notice so it kind of depends on what the software portfolio these developers represent. Sure, they can go to android but if they are struggling to make money on the iPhone it doesn't seem likely that they will do all that much better on the play store.

      That said they do have some valid gripes. Free trials would be ideal for certain types of software but when you can just delete and re-install an app to get around it then it isn't all that useful, leaving developers to find ways to distribute locked version of their software with an in app purchase to unlock additional functionality. Good for some things (play the first 5 levels of my new game) but bad for other things (try out this GPS software that will only get you 80% of the way to your destination until you unlock it).

      Apple has very little to loose.

      Broadly speaking the only apps that won't be immediately replaced by a copycat are the ones that are gateways to third party services, and those apps are already free, and the service sold in a way that bypasses Apple's cut. So the owners of those apps are unlikely to risk losing paying customers over an app they already give away.

      If Angry Birds gets pulled someone will release Surly Bats. And if Netflix pulls their iOS app it'll hurt Netflix a lot more than it'll hurt Apple, both from loss of subscribers who's primary viewing choice was an iOS device and from Apple having their own video library.

      Good for some things (play the first 5 levels of my new game) but bad for other things (try out this GPS software that will only get you 80% of the way to your destination until you unlock it).

      Lots of app offer free versions that have ads, or limited features. Nobody would make a free GPS that only gets 80% of the way, but they could make the paid version have extra features, like 'remember where my car is parked" or voice navigation.

      IMHO, the trial version request is easily worked around.

      No, its not. I gave you an example for which feature limits doesn't really work. It does for some types of apps but for others a time limited full featured app is really the best way to show a user what they will be paying for. Making a GPS app that has some cool features but not letting anyone try those out before paying isn't a good marketing tool, I don't know if your feature will work well enough for me.

      Just because the app you make can be marketed effectively using feature limits or watermarks on outputs or whatever doesn't mean that everyone else's can and thanks to sandboxing its not practical for the developer to create a time limited app, if apple would even allow it, because the user can delete it and install a new copy at any time

      Personally, probably not, but what about 10 bucks... what if its an app I only need rarely... what if I'm a cheep skate. People used to do this same thing with demo software back on the PC but back then you could hide a file somewhere or flip a switch in the registry or something to indicate a previous install. Why would a developer go to those lengths if people weren't working around their demo protection?

      Without some actual enforcement what you have is shareware, which is fine but isn't always a good model for people who want to make a living making software.

      That's... not how unions work or why they exist. Traditionally they've existed precisely because employers have monopsonies on employment for the workers concerned. If there was no monopsony, the employees wouldn't need the union, they could just hop onto a rival employer.

      The software developer "Toca Boca" has public several free versions of their apps that have just the first few levels. Something like "Toca Town Free" .. and then you spend the $3 to buy Toca Town if you like it. So isn't this already doable? What is everyone unioning up about? They want to do trial versions a third way? (The other way being the free app that has an IAP to get to full functionality -- I personally hate that.)

      You say that as if it's not worth anything... media coverage, I mean. But as far as forming a union goes, aren't there already unions for such people? Why reinvent the wheel? They're authors, in a sense, so... isn't there a union that covers authors? Or artists, in as much as if the app they design has an interface you can SEE, they are unavoidably visual artists, too... and if the app makes sounds that they created, (and I know this is under most circumstances a bit of a stretch,) couldn't they be considered musicians, after a fashion? I wish them well, but it's hard to imagine how this will work. There's no shop you could bar people from, to prevent them coding for Apple's app store or platforms; I doubt very much that anyone will have much success threatening people (or suing them) for coding for Apple (directly or indirectly, as an app dev,) and NOT joining the union... really it sounds more like they're forming a club, or perhaps a support group. They may NEED a union, but I don't see how it will work. OH! How about IBEW? I mean, they make instructions that make electronic devices, (powered by electricity,) do stuff, doesn't that KINDA make them electrical workers, in a sense?

      Actually, that does make me wonder, are Apple's own employees unionized? If not, could they, and then let anyone who makes stuff that works with or on Apple products join? Would you have to make your app Apple-exclusive to be eligible to join? Like, what if you make an app but make it on multiple platforms? Okay, now I'm just rambling so I'll stop, but I think this raises interesting questions, and I am looking forward to seeing where this goes.

      thanks to sandboxing its not practical for the developer to create a time limited app, if apple would even allow it, because the user can delete it and install a new copy at any time

      Make it phone home on first run, link it to the user's store account.

      Supply and demand. The App makers and sellers are their own worst enemy, they are each competitors to each other, fighting over the same income. The more app developers the worse the returns, simple as that. Too many, similar apps will eat each others revenue, overly compete upon price and basically earn bugger all. Forming a union utterly pointless, you can not force you customers to be treated as employers, they choose to buy or ignore you product. Reality is, I installed apps and after a while found the default ones to be enough and uninstalled all the redundant aps and disabled built in ones I was not using.

      There are quite simply too many app developers and so you eat each others lunch and starve ie go bankrupt, nature of the market. Not making enough money as a app developer for Apple products, stop and do something else, such is life. Keep in mind, any new aps have to compete against all the existing ones and the more there are the stiffer the competition.

      Want to make money on apps, do what the corporate types do. Pay lobbyists to pay politicians to force government departments to buy those aps, whether they use them or not, buy them in the millions.

      Google gives you 15 minutes to request a refund. That's usually enough to see if the app is worth a few bucks.

      IAP is the most convenient thing ever. These "devs" would have died of starvation back in the shareware era...

      The thing is, it's not nearly enough money to make Apple care. Apple is barely going to feel it. Their only hope is to make enough noise in the media to embarrass Apple. So it's only going to hurt the Developers because the App Store is overcrowded anyway and there are still dozens of starry-eyed suckers who think that 99% of App developers don't lose money.

      A free trial *is not* "the return of shareware".

      Almost every piece of software in the enterprise and consumer world has free 30 day trials now, most of them delivered via cloud. Consumers don't want to invest a ton of money into something that won't work for their use case. If you're talking about a $0.99 game that is one thing, but some productivity apps can cost $8 and up. Paying $8 for something that turns out to not be useful at all, that stings.

      Google figured this out forever ago - the play store has had free trials since inception. They used to be 24 hours, now just 4 hours - however 4 hours is plenty long enough to install an app, set it up, and try it out before deciding if it is worth actually paying for.

      I'm in game development. In our industry, free trials have been shown to reduce sales so we don't have "demo versions" anymore. PC games are typically more expensive than mobile apps so the purchase price doesn't seem all that important - it's more about allowing the transaction to occur at the peak of the user's interest in the product. Steam does this very well by making the purchase/download quick and easy. Free trials get downloaded at the peak interest, played through, and the customer then goes to bed and most likely doesn't think about the game again. The next day they hear about and download another game.

      There were many kinds of shareware: limited time, limited functionality, nagware, and guiltware, just to name a few. The early BBS says lacked the monetization sophistication of modern apps, but they did try quite a few approaches.

      A free trial is a specific form of limitation. It is a way of limiting use of software in and of itself, but would be a subset of shareware.

      A free trial is by its definition fully functional software that is time limited.
      If the software is limited by features, it isn't a trial as you can't test and verify those locked out features.

      This is certainly one way shareware can be restricted, but by far not the only way.

      Restricting what features are available is another way shareware can be restricted, but this is most often not any way to try the software as a whole as a trial would usually need to be.

      Shareware authors would usually choose a limiting method that made sense for the type of software it was, balanced out such to encourage most people to purchase the full version over making it usable enough that people would not pay and just keep it in shareware mode.

      mIRC, a Windows IRC client (it used to be the most popular one) is one of many examples of shareware that initially only utilized a nag screen on launch.
      People got the idea that you can just leave it running 24/7 to avoid the nag screen, and the devs said that in over a decade they had less than 3 registered users, despite multiple millions of downloads and users.

      However, unlike your claim, the above software was definitely "shareware" yet had no time limits or even feature limits while it was unregistered.

      When you say shareware, the assumption is that you get a limited version for free, and you pay more to get the rest. Time-limited trial software is specifically known as trialware.

      Meanwhile, the MS Store had it for as long as the dev wanted. One could get the app in Trial mode, and then upgrade the app to full license

      The app even *knew* if it was licensed or not - so it could have good old shareware-style limited features or shareware-style nag screens or shareware warning of impeding suspension of license.. But it was the same app, same code, same entry in the store. Upgrading the license wasn't even a re-download, just the OS now told the app of its higher status when it asked!

    Around 85% of smartphones worldwide are Android. THAT is why you're not making any more. Maybe follow the lead of most PC software manufacterer's and ignore Apple and their tiny market share. They're not worth the time and hassle.

      There's this concept that Android users won't pay for software; that's too bad because I hate, hate, HATE advertisements and will gladly pay a few bucks for the app. But the vast majority of software that is in the Android store is ad supported/free. They should bring their software over to Android where it's easy to release two versions of any app; a free to try/ad supported version and a paid version without ads.

      You are correct that most smartphones are Android, however you are gravely mistaken about mobile economies. Apple accounts for over 65% of all mobile revenue in the world, the reason is simple, Android users are poorer, and more likely to root their device and steal everything. I'm not saying this is good or bad, they are simply facts.

      You don't make money on Android apps. Even if they held 99% market share, most Android users don't purchase apps anyway.

      iOS users will at least pay some money. But Android market share is based on cheap crappy phones with older Android versions.

      It is worth the time and hassle for small developers to pursue iOS users. You are wrong.

      It is genuinely hard to believe this level of ignorance still exists. Android may well have (many) more phones out there, but that's completely irrelevant. Marketshare does not equal profit or revenue, either for the hardware vendor or for the app software vendor. There is more money to be made in Apple's ecosystem because something like $2 is spent in iOS software for every $1 on Android software (Android downloads are higher than iOS). It's also a royal pain to support Android because of the 2 zillion handsets out there running different resolutions, OS versions, and hardware. FWIW OP doesn't claim iOS developers don't make any money.

      There are 2 main outcomes with having a free ad-supported version and a paid ad-free version. Outcome 1: the ads are tolerable and don't affect affect software performance, so no real need to upgrade to the paid version. Outcome 2: the ads are a pain in the ass or limit/reduce functionality of the software, so the user says "forget it" and moves on to something else.

      Android is open source, as is much of the software. It's not always a matter of cheap so much as there are plenty of free (or ad based) options because people contribute back as opposed to the Apple ecosystem where people are trained to pay for every little teeny thing they want or need.

      The last client I worked for offered their product on Android and iOS. They had three developers working on the iOS version and 12 people working the Android version. Android users accounted for about 1/3 of the revenues, and well over double the support costs. If it were up to me, I'd have dropped the Android version altogether.

      Exactly! Apple users pay and are used to paying for the apps they want. Android users have been trained to get everything for free with ads, so they're not used to paying for everything. If the developers move their app over to Android only, that's fine, but they'll need to make them ad-based so they can earn some money.

      I'm an Apple user and I've started to see a lot of Apple apps move to a subscription-based fee rather than a one-time app purchase cost. I didn't mind purchasing an app and then paying for a new upgrade if I needed the new features, but subscription based might force me to move to Android and get the free stuff. I just really enjoy Apple's walled garden more than Google's. Of course, maybe it's time I evaluated whether or not I even need a smartphone. I did just fine with a paper notebook and pen, and a basic mobile phone with text.

    I'm all for Apple making money off the Apps people put into the App Store. It's their Phone, it's their Platform. They deserve to make money off that. But THIRTY FUCKING PERCENT OF ALL In-App Purchases?? That was never a fair shake and was a definite cash grab meant to exploit the work of the Developers creating those Apps. There is simply no way to justify taking 30% of the revenue from the Developers who toil to make those Apps. I think it's time Apple slashes it's cut and substantially. And by substantial I mean just that -- at least half, down to 15% or even 10%. Perhaps these Developers can attain some critical mass and have enough weight that they could yank all their apps and make a considerable dent in the App Store. That sort of move would get attention and provide some leverage. It's high time Apple stopped fucking over it's developer base, who has been a large part of the reason for the iPhone's success.

      I'm surprised a liberal entity such as apple doesn't have a reverse tiered payout ratio. So the top 10% of revenue earners get say 60% of their app revenue, then its a sliding scale down to where you are in the store, so then the bottom earners get 95% of their revenue. This would seem to make a whole lot of sense as it there is a huge incentive to make a new app and start out.

      When the App Store started, I recall several independent Mac developers stating that their overhead for advertising and selling software through third-party payment platforms like Kagi was high enough that the difference between that overhead and the App Store 30% was offset by the convenience of distributing through the App Store, especially since it freed up time to actually develop.

      Times change; Apple has done much to streamline the app submission process (I remember when much of it was command-line based), even as the complexity of preparing an app (entitlements, etc.) increases. I haven't really evaluated what's fair recently. Authors of free apps will never make money at it, even if Apple took a 0% share. Developers whose apps take off in popularity will probably be rewarded beyond their dreams.

      For me, my two apps in the App Store haven't paid for themselves (when I factor in overhead for various tools, web hosting, etc.), but they were essential in my getting the necessary credibility to land well-paid positions writing software for iOS, which I much preferred over my previous years working with Java.

      I can relate to the desire for support for things like support for free trials and upgrade pricing, but I don't agree with the confrontational approach. With respect to the people I know (or know of) on that list, count me out.

      You can point to say Apple donating to homeless shelters in Cupertino. I could say they did that to butter up the Cupertino city council so they'd be allowed to expand their parking lot. So donating to that homeless shelter gets paid back in sales ten fold.

Not only is it easy to earn a living from being a software engineer, most of us make a really good living from it. How many apps aren't created by independent developers but are instead created by companies with teams of developers? They're not going to join a union. A union would only works if enough app developers join it. The fact that you can't make a living from it tells me that the app store is over saturated with apps.

    Though their sentiment and goals are worthy - retain a higher percentage of your work - forming a "Union" does nothing if scabs ( https://en.wikipedia.org/wiki/... ) are allowed to post apps for less return. This is no different than Lyft/Uber lowering pay for cab drivers, there's no way to form a virtual "union line" to keep scab apps out, so this movement is predestine to fail.

    The Google store used to do this. They'd allow you to uninstall an application within, I think it was an hour or two, and you'd be refunded for it.

    When I think about it, I was more willing to try paid applications at that time. I don't mind paying a buck or two for something that's going to serve me well, but I do mind paying a buck or two for a steaming pile, or even for something that works okay but isn't really to my taste.

    I don't know why they quit doing that. I'm a lot more willing to try something out if I can kick the tires a bit before I'm committed to paying for it. I hardly think I'm the only one.

      That policy is exactly why I never wasted time developing for Android. Users could demand a refund anytime and it would come out of future revenue. So, five years from now, you stop updating you dead app, it becomes obsolete and removed from Play. All the users demand a refund since they have nothing to lose, and just got 5 years of use out of your app. Now, that comes out of any of your future revenue from other Play projects. Horrible, horrible model.

      No, they couldn't. There was a time limit, I think an hour or two. That's long enough to decide if the app is worth what you paid for it, but not so much time that you could do whatever you wanted with it and get a refund a month later.

      If they were giving refunds to people years down the line, it was in some other way, not the auto refund via Google Play since that was only available for a short while. But I would tend to agree with you that it's unreasonable to demand a refund for something that went EOL after being maintained for several years, especially when most of those apps only cost a buck or two. If I got five years' use out of an app I like for a couple bucks, I would certainly think I got my money's worth.

      You can do this with in app purchases on iOS, and plenty of developers do but there are some types of apps that don't work well with this model (try my GPS app that gets you 80% of the way to your destination... pay $5 to get the full version) and are much better with a time boxed full featured demo, but you would have to make it so that the user cannot just delete the app and download it again.

      Also, don't call yourselves a union when you're just a fraction of the labor force. The entire point of a union is to band together to form a group big enough that if you stop cooperating with the employer/host, their business will suffer. If you don't hit that size threshold there isn't much benefit to forming the group.

    The android developer here spent a fair amount of time making an ad-free upgrade option for some (fairly well selling) android game. He sold 6 copies.

      For the amount of time he put into it I doubt it'll ever earn enough to be worth his time, but he didn't do it for that. It was a game written with passion for the type of game it is. There is no free version but it seems to be doing alright. I think he could have been getting $5 per copy but he said, and I'm not joking, that he would rather have more people enjoy the game then to make the extra money.

      I know I'm bias but that game is so good he should be getting some serious money from it, but he's not. I see it as evidence that too many people on Android won't pay for apps. People in the Apple store will.

      Interestingly, his first app which he released on Apple, Android and Windows got the most downloads from the Windows store.

    I don't think 30% is high at all for what you get in return.

    Apple has hundreds of millions of customers around the globe with payment information on file, so all they have to do is click on you app and confirm they want to pay.

    You don't have to worry about hackers messing with your payment system to grab customer payment info. You don't have to worry about complying with privacy laws across scars of countries.

    You also don't have to worry about standing up servers that can take any amount of traffic from anywhere 24x7, for both fetching the app itself and application related resources.

    They also handle the update process without you doing any work or having to send out notices of new versions.

    It's crazy to me to complain that everything an application developer gets in return is worth less than 30% of revenue... if that's really a problem can't you just charge more? No? Well I guess you were never a serious business to begin with if you were entirely dependent on that whole infrastructure making your application possible to begin with and can't survive when you charge customers the amount you need to survive.

      The 30% is certainly high for companies that already have everything you described, like Amazon and Microsoft. There's a lot of tension there, to be sure. Even for the little guys though, I can see people pushing to negotiate that 30% down somewhat, especially if they have a variety of toolkits that each take a fixed %, leaving the dev with less than 30% of each sale.

      If they require the same backend and bandwidth, why does the administration of the $3 app cost only 90 cents, while the $200 app costs $60?

      eBay basically offers the same thing. Tons of views, free hosting, security, tutorials, product databases so you don't have to enter in all the details, etc... They never take more than 10% + 30 cents. Apple has plenty of spare cash to not need to price their monopolistic services so high, but then again that's why they have so much spare cash.

    Because if they don't, the organization shuts down. But while the ride lasts they get paid first, regardless of their performance.

    As a self employed contract computer programmer with 30+ years in, I do hope I am wrong and wish them success in their efforts.

    Around 85% of smartphones worldwide are Android. THAT is why you're not making any more. Maybe follow the lead of most PC software manufacterer's and ignore Apple and their tiny market share. They're not worth the time and hassle.

    Research from a few years ago showed that iOS apps had over 5x the revenue per download as Android apps. I believe the methodology was to compare Apple's and Google's published data for number of apps downloads over the year and the amount paid to 3rd party app developers over that same year.

    Now consider the nature of many of those phones. According to Apple's and Google's current statistics to reach 90% of the current visitors to their respective app stores an Android app has to target the last 4 major version of Android and an iOS app the last 2 major versions, the preceding includes the current version. This increases development and testing costs for Android apps.

    Its quite naive to think things are as simple as the number of phones on each platform. Perhaps you aren't qualified to call others idiots.

      If I understand things correctly that change does not really address this problem. Many of those phones cannot upgrade, this includes phones currently sold. Last I checked a few months ago an inexpensive pay-as-you-go phone at Walmart could be stuck at Android 4.4 KitKat. Plus this change is only addressing the lazy developers that just targeted 4.4 KitKat and use an ancient SDK and libraries and rely on that running everywhere. While google may require that apps target the current major release and use a current SDK and libraries they will still allow compatibility with the old versions. The developer will have to target Android 8 Oreo and add conditionals as necessary to support deprecated and other 4.4 targeting code. Google is not making anyone drop support for old versions. If they did that many phones would become unreachable to developers. I believe google is just requiring that developers use current SDKs and libraries, and at least indirectly have better "native" support for the current Android version. Yes "native" is a somewhat overloaded term here but I hope you get my meaning, current SDK/libs better support for current Android. And I'm sure that google also hopes developers will be a little less lazy and perhaps support some feature only offered in the current OS. There are probably also newer things that developers will be forced to support, for example newer security models.

    I think we can safely guess that these folks are in need of a reality check. You are not entitled to make money. You have to make something people value. Not because they "should" value it, but because they do. Just because you worked hard doesn't mean people have to like what you built, and you will be profitable.

    If IOS app development does not present a profitable target maket for a developer, then donâ(TM)t develop for it. It doesnâ(TM)t really matter the reason. If you develop an business model that it is difficult to be profitable, that is your fault (as long as the rules were changed mid-stream).

    I donâ(TM)t develop applications for Amiga computers. Nor OS/2. While I may find it fun, I would not be able to make a profit. So instead I develop around Windows mostly. I get the reasons they are not profitable are different, but that dois ant really matter.

    And if developers simply choose profitable markets (say android), they can only win! They will...make money! And if this has a meaningful impact on Appleâ(TM)s bottom line, they may change policies to make it profitable for devs (double win). If not, oh well, you are already profitable by developing for a profitable market.

    Nothing here to create a union about. I honestly canâ(TM)t imagine, the thought just boggles my mind.

    Maybe Iâ(TM)ll create a union to complain to Stallman about how GNUâ(TM)s licensing makes it difficult for me to sell proprietary solutions to customers. Now I don't want to seem too harsh with that statement, many of these apps are from beginners so the fact they started a project and got it working and published it deserves much praise - these beginners are demonstrating much potential talent, yet it is still only potential talent and most apps are generally mediocre.

    You can download any MS Office app today; you can't run it without an Office365 login.

      The Kindle app does not let you buy books, there is no war at all. You buy them on Amazon and read them on the Kindle...

      For Microsoft a similar deal, you subscribe to Office 365 outside the apps and they use a login.

      This further reenforces my point; if you are a large enough company you can get around the 30% figure - because you have the resources to set up your own payment and user gateways. The 30% is reasonable for smaller companies that don't want to take the time and effort it takes to stand up reliable infrastructure for all that.

    I'd be okay with free trial, but I'm concerned what these developers want is a way to get people to pay who forgot they even have the app.

    All too often these offers actually mean "free for 30 days then we automatically bill you full amount unless you jump through these hoops you'll forget about by then".

    If it's a legit free trial, i.e. app stops working and asks you to pay, then fine.
