I don't believe so. Because Spamhaus did not appear (which they shouldn't have), the judge settled by default. If the company was based in the US, they would have appeared as they have to follow US laws. Then they would have won and probally brought a known spammer to his knees.

I used to work for a hosting company (a shitty one). Spam was indeed against the AUP. But as long as the spammer was not over using his resources or clog up the network, nothing was said. Really the only time something was said was when they sent so much spam out that the processes brought down the machine and they called for support. Then the answer was "your sending too much email". After about 4-5 calls, the AUP manager would get the issue and let the customer know that sending spam was against the AUP. And what was the price for breaking the AUP? Upgrade.

I just tried it out. It's really not that bad. Actually, really not bad at all. I, for one, actually like it. I'll probally never use most of the extra stuff but I do like the new layout. It helps me view the emails quickly to skim of them. When people say its slow, they are just stupid. It does take a second to load but after its loaded there's no need to open multiple links to view the messages and keep pressing the back button to read the rest. As for the ads, yeah they're there. Thats cause you didn't pay for it. If you notice, the other version had adds two. This just has the ads down the side instead of accross the top.

As a result of everything I did, Web surfing got a lot more difficult. It took a few seconds longer for pages to load, and I received error messages from certain sites, which apparently balked at my not having cookies.

The reason you recieve error messages is cause the sites were built to track you. If more people became anonymous then, the sites would be built to not track you. If a new version of IE (i hate it but all the "i bought a computer, can i have a fork?" retarded people use it so more people use it than most others) came out that by default had you surf anonymous then the sites that track you would grow less and less popular as the people get errors and go to other sites where they dont get errors. This would cause the designers to change the site and make the error vanish. This is like anything that you change, its going to be a little annoying at first but youll kiss yourself after a while at how much better it is.

I agree that its good for kids to get outside (I personally only go out cause I'm forced to go back and forth to work) but, if you really think about it, the more a kid stays inside, the more he plays his/her game (increasing hand-eye coordination and troubleshooting skills among other skills) or sits at his/her computer looking up interesting topics (teaching research skills and also learning more and more) the smarter the kid will be. I think all the 'anti-technology' opinions you read are people scared of being left behind.

Also, I believe this whole article is just a marketing ploy by authors. Like the comment to the post states "A child who spent all day reading violent books would not be well adjusted, but there is nothing to stop a child walking into Waterstones and buying a Bret Easton Ellis or Irvin Welsh book..." I think the authors are trying to discourage technology among kids to get them to buy thier books. And I've never personally read Philip Pullman but a quick wikipedia shows some similaritys between his books and most video games out there they both "[...]feature children facing adult moral choices, talking animals, religious allegories, parallel worlds, and the fate of those worlds hanging in the balance."

The only way to stop spam without completely removing email is to educate the poor smucks and cause spam to not make money.
