I have two comments:
1: I'm sure there are fines for jay-walking. So you don't need to charge people legally crossing the street for talking on the phone or listening to music or, heck, reading a book.
2: If you are hit by a car while legally crossing the street, does it matter whether you were talking on the phone or reading a book or just lost in your thoughts? Isn't it the driver's fault regardless?
But maybe that's just too much common sense to expect from the legislation.
