    Are you blaming Mono for chasing a moving target? Microsoft and their bitch HP are calling the .Net specs "open standards" because they have older versions rubber-stamped by ECMA, but they only cover a fraction of what Microsoft's implementations have, the rest needs to be reverse-engineered. And I think you overstate the relationship between Microsoft and Novell unless you feel that taking any money from Redmond make them "unclean infidels"...

    One of the tenets of the theories that detractors call "Darwinism" is the survival of the most adaptive. Where do you get the "fittest" part from? Celebrity creationists like Ben Stein? And that is far from the only genesis story either, there is for instance the ancient Chinese one about a God being born from an egg and rising up to lift the sky. "Let there be a crack"... Why should yours be right and that one be wrong?

How would any of the single-touch, resistive-screen pen computing tablets apply to a device with multi-touch capacitive screen?     The patents the others hold are either licensed by Apple, or by third-parties they use. Plus, they are "standard-essential" and thus fall under different rules than non-essential patents like the bounce-back scrolling.

    Any reparations from that overturned ban would come from the bond Apple had to post to get the ban in place.

    Not sure how it would affect the other ban in Europe, but there Samsung relented and made the non-infringing Tab 10.1 N.

    What do you mean by "creative" here? How is a Mac limited? Mac OS ships with creative tools like Garageband and iMovie, for instance. It ships with a complete IDE instead of letting the (Windows) user either download a crippled one or pay for the privilege of building with a "proper" version. How does Apple limit creativity more than the alternatives? Not everyone wants to write their books using LaTeX or play around in Excel.

    The patents were valid because they were granted by the USPTO. That is actually all that is required. Just because freetard know-it-alls comes around and say they are obvious in hindsight does not mean Apple weren't first to actually do it. Learn the difference between "could have done" and "did".
