  1. Re:Wouldn't there be easier ways to sue him? on DMCA Means You Can't Delete Files On Your PC? · · Score: 1

IMHO, this is one of those suits which is likely to be dismissed as a)frivolous, b) unenforcable (as has been already mentioned) Remember, it's simply a lawyer's opinion at the moment - it still has to make its way through due process, and I doubt that's likely. On another note, it's a shame that the courts are continually tied up with suits like this - it's just another way for someone in the legal profession to collect fees - whether he wins or not. (And certainly the publicity doesn't hurt either, unless the whole thing backfires on the lawyer.) Sure, the guy being sued will sweat for a few months, but it'll likely turn out he'll be vindicated. Question: does double jeapordy apply here? If he "wins" the suit, i.e. has it dismissed or otherwise declared invalid, can they still get him on the fraud?

I'm always amused by the hordes of seemingly useless people that participate in the production of a movie. Perhaps all the people are needed in some way, but the titles in the credits always scream 'bloat' to me... (from Ichigo2.0)

Then I would suggest perhaps you look into just what each of these "useless" people are doing; movie companies are like any business (outside government-run) which usually like to run "lean and mean." They don't hire "useless" personnel - if someone slips thru the cracks, they're replaced rather immediately. Each position has its job description, and someone to fill it. Someone who had to go thru a bigger application process, proving worth, than one would applying for their first job at the local hamburger & ice cream stand. Check out one of the movie-making sites, or better yet (if you're allowed) visit a movie set of a production in progress as I did once. The hours are incredibly long, the work at times is very difficult, and the synergy and sheer human processes which carry on under sometimes incredibly difficult conditions are nothing to be commented upon by people who do no, cannot, or will not understand.

I often wonder why someone has to die, or a great (unatural) disaster has to occur before anyone, professional or politician, ever does something. Why all of the training, the years in college and university, not say on-the-job experience, under which someone goes, and we _still_ are never proactive in these kinds of situations. It's almost as if the mindset is, "Well, nothing's happened YET!" But when it does, there seems to be no end of finger-pointing (and ducking said fingers) instead of the question which needed to be asked: "Why didn't someone foresee this, and at least _try_ to do something about it, _before_ all these people died or were hurt?!" Makes a lot of sense to me!
