I'm glad you pointed out domain names are navigation tools. Domain names are not for public statements, that is web pages. Domain names are purely navigational tools. Also, if he would have had web pages instead of click-throughs and ads and what not, the claim would not legally hold up I don't think.

I won. As of 8:56:14 Eastern Standard Time, the nerdfarm.org domain name was modified and pointing to a functional server.
For those of you who dont know, nerdfarm.org is a community discussion forum that is still under development but is mostly functional. If you are interested check back to nerdfarm.org in a couple of days, and I'll get the about document posted up there.
You can use another registrar as your army against NSI actually.
If you look at register.com's page they have forms about transferring from NSI or anyother domain name. You give register.com the forms they need (and sign over control of the domain to them) and they work with NSI to get it changed and you just have to pay register.com a new registration fee. I am still trying to pull together the right documents for this.

I'm thinking you may have had a fortunately coincidental good experience with them.
They refused to acknowledge my first fax on the basis that it did not properly prove my identity. I fax it again after talking to a customer service representative and he said it was lost so he couldn't verify it. That one was lost too. I faxed it again -- same document, and that one went through. 2 days later I get an email saying they updated my contact record.
The next day it still wasn't updated. Sent another email, never got a response and on the 3rd day it was updated - that was from a Monday to a Friday, 5 days it took them.
Now that I have my updated contact record, my domain is still not being updated and when I last attempted to resubmit my change request (today) I got a response saying the changes where pending even though on Monday I got a response saying the account was changed. Tuesday I get another response saying that I have to fax them the authorization again.. This is just stupid.
And that isn't even going into the process of events leading up to this which was even more painful - but I'll post those emails at some point later on.
Either way, I've done everything they have documented and told me to do and I still do not have my domain working, after 2.5 months of trying. It really is unacceptable practice in my opinion. Goes to show you why they have lost 60% of their market share, if they had a decent service I'm sure a lot of people would stay with them. Last time I register anything throgh them though, and I hope I'm making an impact to reduce another half a percent of their market share because they really deserve it.

If you look at register.com's page they have forms about transferring from NSI or anyother domain name. You give register.com the forms they need (and sign over control of the domain to them) and they work with NSI to get it changed and you just have to pay register.com a new registration fee. I am still trying to pull together the right documents for this.

I'm thinking you may have had a fortunately coincidental good experience with them.
They refused to acknowledge my first fax on the basis that it did not properly prove my identity. I fax it again after talking to a customer service representative and he said it was lost so he couldn't verify it. That one was lost too. I faxed it again -- same document, and that one went through. 2 days later I get an email saying they updated my contact record.
The next day it still wasn't updated. Sent another email, never got a response and on the 3rd day it was updated - that was from a Monday to a Friday, 5 days it took them.
Now that I have my updated contact record, my domain is still not being updated and when I last attempted to resubmit my change request (today) I got a response saying the changes where pending even though on Monday I got a response saying the account was changed. Tuesday I get another response saying that I have to fax them the authorization again.. This is just stupid.
And that isn't even going into the process of events leading up to this which was even more painful - but I'll post those emails at some point later on.
Either way, I've done everything they have documented and told me to do and I still do not have my domain working, after 2.5 months of trying. It really is unacceptable practice in my opinion. Goes to show you why they have lost 60% of their market share, if they had a decent service I'm sure a lot of people would stay with them. Last time I register anything throgh them though, and I hope I'm making an impact to reduce another half a percent of their market share because they really deserve it.
