    "Access" and "use" have always been clearly defined and distinct in copyright law. "Access" is acquisition, "use" is obviously use.

    I believe that the disctinction between access and use is to be found in the textbook _Nimmer on Copyright_ and not in copyright law.

    You don't have access to the Copyright work ... the movie. You have plenty of access to the disc -- its not Copyrighted.

    So you're telling me I can make bit for bit copies of the DVD and the MPAA won't come after my ass with a great pointy stick? Tell that to the latest ring of pirates rounded up in Hong Kong.

    Actually, I have read every one of the transcripts released to date. In brief, Judge Kaplan has been very hard on the defense and has made some arguably incorrect rulings. If you read between the lines, he has also been helpful to the defense by outlining the areas where the defense needs to tighten up its case. Kaplan also tole the plaintiffs that if they couldn't show actual harm they didn't stand much of a chance of prevailing. Yes, Kaplan has been tough and perhaps wrong, but I don't think that it necessarially amounts to bias.

    According to a friend of mine who works as a network manager in the Federal Court System
    Kaplan is one of the more technically competent judges. If our case is as strong as I believe it to be, a technically strong judge is an advantage.

    The defense have been preparing for an appeal from day 1. Part of this means that they need to get their objections and legal arguments into the trial record where they can be reviewed by the Court of Appeals. Kaplan's rulings to date have indicated the eventual necessity of appeal and have provided some of the basis for that appeal.

    Um, it controls the market by controlling access to the discs. Hence it is an "access control device".

    What do you mean by "access". If I purchased a DVD disk and brought it home, do I not have "access to the discs"?

    Part of the defense is the examination of various models for "authorization". Under the DCMA, "circumvention" is defined as "access without authorization". How specifically are people authorized to view DVDs? The only way that the rights retained by the people under copyright can be retained is if "authorization" for DVDs is granted at first sale. Under this authority model, DeCSS does not circumvent as defined in Section 1201.

    The real question is why it took as long as it did for this to come out into the open?

    It was discovered by the defense in depositions taken last week. It is possible that Kaplan never knew of the specific work that his firm was doing for Time Warner.

    He was a partner in the antitrust practice of a firm that had Time Warner for a client with respect to DVD issues and possibly antitrust aspects of DVD issues.

    In a large law firm, not every partner knows the details of every client. There is no allegation that Kaplan himself actually worked on the Time Warner case. That kind of information is just not available to the defense unless they happened on a document that he wrote.

    The motion to disqulaify is based on an appearance of conflict.

    But:
    - If your time has any value (and you don't want to waste it making connections)
    - If your safety has any value (and you don't want to risk it riding unarmed on a bus/train load of teen gangstas)
    - If your quality of life has any value (and you don't want to trash it by moving to an apartment next to the tracks)
    you'll generally find that you're WAY ahead in a driver-only car.


    Funny, I ride the commuter rail every day. I get stuff done on the train because I don't have to drive, I arrive at work more refreshed and ready to work because I didn't have to deal with the idiots on the road, it costs me less to ride than to drive and the tracks are a block away within sight from my front door, but they are not in sight from my backyard where I can go to escape them. Furthermore, I have never had my personal safety threatened and I use an expensive laptop with cell modem on the train twice a day. Keep your car. I don't want one.

    Gee.... MAPS can't be any more hypocritical there. MAPS' whole reason to be is because they claim spammers are tresspassing on peoples' net connections. Yet, if you ban MAPS, no matter whether you have an open relay *OR NOT*, you are listed as being an open relay.

    You seem to be confusing MAPS with ORBS. ORBS does testing for open ralays. MAPS works on the basis of actual SPAM received.

    err...and what exactly is the reason for having to unmount a floppy ? how bout a straight push this button and it ejects thing?

    Because it you do it at the wrong moment, it can scramble the disk beyiond all repair.

    Because the floppy is a slow device and the OS can buffer the disk contents for faster I/O if
    it knows when the disk has changed.

    Because a program might have a file open on the floppy and it would be very unhappy not to be able to save when it needs to.

    Just because MSDOS used a stupid floppy model, dosn't mean all OSes have to slavishly follow.
    The Mac has *good* floppy handling. Better floppy handling than PCs. New devices like the Zip Drive have Mac-like media locking.

    There was a huge discussion on the Linux Kernel mailing list in the last few weeks about how best to do floppy handling. Even if you have no interest in Linux, it is informitive on the limitations of PC hardware and OSes in this regard.

    If you are worried about the wind you build the building so strong it can't be hurt by any windstorm.

    Risk Management is a lot more sophisticated than this. A Risk Manager would consider the cost of new construction vs. the cost of insurance vs. the potential loss and the probabilities of that loss.

    The insurance discussed in this article is not for the little guy. The little guy also dosn't have a potential loss measured in the $millions/day of lost sales.

    20 minutes on a platform you had never used before? That's not too bad.

    When one sits down at a new piece of hardware/OS it takes a while to find your way around. Especially when you have new concepts like "unmounting a floppy" to figure out.

    Unless you've redefined "intuitive" to mean "Exactly like WIndows".

    Insurance works when the event you are insuring against is out of your control. Business interruption insurance for various wind perils is entirely appropriate and economically viable because wind perils are (1) unable to be anticipated and (2) not controllable by the insured.

    Insurance against Hackers or Crackers is uneconomic because the element of controllability is not present. The organization has various means at it's disposal to avoid service disruptions from firewall configuration to fully-redundant, offsite backup servers. Yes, they need good Risk Management, but Insurance is not the answer to every Risk Management problem.

    Though if some deep-pockets on Lloyds want to chance going broke on poorly-conceived Insurance schemes, it wouldn't be the first time.

    I'm beginning to think that it makes more sense for the case to be heard by the court of appeals. (See my user profile for plenty of opinions why it should go to the SC) The SC takes the summer off. They will be off from next week until the first Monday in October. The Appeals Court can get a lot of work done on this appeal between now and October. Conceivably, they can have a ruling to pass up to SCOTUS for review by October. It just seems like a more efficient use of time.

    I gave my 2 weeks notice and on the day before I planned to drive from Chicago to New York, I got a phone call that there was a warrant for my arrest in Chicago for failing to appear in court to answer a drug pusession charge. I was told not to report for work on the following Monday. After making a few calls in Chicago, I was reassured that the whole thing was bogus -- no one had a warrant for my arrest. I drove to New York and the background check people sent someone to the courthouse to get a copy of the warrant which was for someone with the same name but a different birthdate. The company did the right thing: I started on Wednesday instead of Monday and got paid for the two days of work I missed while they were clearing up the problem. I just had my 5th anniversary with them last month.

    The background check folks screw up sometimes. You need to get the report in writing from them -- you are entitled to a copy under Federal law. You have a recourse if they refuse to correct gross errors and their failure to correct causes you financial damage.

    Antitrust cases are the exception to this general rule. Findings of fact are reviewed (I believe that correct term is that the case is reviewed de novo form the beginning) though it is unusual for an appeals court to reverse a finding of fact.
